Mary Laney's criticisms of the 9/11 Commission [column, Aug. 22] and, in particular, my colleague Jamie Gorelick, are totally unfounded.
The Commission was told of the existence of Able Danger in October 2003. It immediately demanded all Able Danger documents concerned with Islamist terrorism from the Department of Defense -- and received them. Neither the officer telling us about Able Danger, nor congressman Weldon nor the Able Danger records names Mohammed Atta or any other 9/11 terrorists. Nor has the recent exhaustive DOD review of its records found any such mention.
One week before publication of the 9/11 Commission's report last year, a naval officer did tell one of our staff that he thought that he had seen a chart showing that Mohammed Atta had been in the Brooklyn in early 2001. By the time of that report, our investigation and that of the FBI made it crystal clear that Atta first arrived in the United States in June 2001. In short, there is no credible evidence -- documentary or otherwise --that contradicts the 9/11 Commission report on Mohammed Atta.
Additionally, Laney's assertion that the Commission failed to report on this program to protect Jamie Gorelick is ridiculous. She had nothing to do with any ''wall'' between law enforcement and our intelligence agencies. The 1995 Department of Justice guidelines at issue were internal to the Justice Department only and were not even sent to any other agency. The guidelines had absolutely no effect on the Department of Defense, and certainly did not prohibit it from communicating with the FBI, the CIA or anyone else.

"We believe that it is prudent to establish a set of instructions that will more clearly separate the counterintelligence investigation from the more limited, but continued, criminal investigations. These procedures, which go beyond what is legally required, will prevent any risk of creating an unwarranted appearance that FISA is being used to avoid procedural safeguards which would apply in a criminal investigation"

Spector should supoena those documents from the 9-ll Commission. The public deserves to know what Able Danger documentation DOD, (Pentagon), turned over to the Commission. More precisely, what was not turned over.

The "Republican" representatives on this commission have been so "non-partisan" (read that: GUTLESS), it has been stunning. It's as if Gorelick is absolutely immune from any potential accusation much less blame. In their efforts to avoid anything controversial, they seem happy to bury the truth. They did everything in their power to avoid any blame or any controversy -- who cares about fixing these problems?
Maybe DOD is now being complicit in the cover-up to avoid politicizing "the wall" (the MSM seems to have backed Rumsfeld into a corner where he can't come out looking OK whatever he does) -- but these RINO commissioners are stepping over the line into sedition to support their buddies on the Dem side. Really really disgusting.
Translation: "People should just stay out of our business."
A massive lie. And certainly John Ashcroft helped to expose it.
And now Gordon admits they were told about Able Danger, and yet originally they said they had never heard of it.

So... The 9/11 Commission received "all Able Danger documents," huh?

Well, as usual, we have two different stories here. The Pentagon and DoD insist there aren't any Able Danger documents. They were destroyed when Able Danger was disbanded in 2000. Yet here we have the 9/11 Commission receiving documentation from Able Danger in 2003.

C'mon... you know Jamie didn't do anything wrong. She even went so far as to make a phone call(to Weldon) saying as much.
This is so typical of Government Investigations. Put two people of each party with some credibility in charge of the Committee and then fill it with fools that all have a political axe to grind (or cover up).
Wasn't Ben Veniste on that commission? If he wasn't a political hatchet person, there are none.
