Menendez is a Cubano. To accuse his family of being illegals isn't accurate. Cubans enjoy lenient asylum laws not afforded to other immigrants. This has made some La-Raza folks resentful of the Cuban Exiles in Miami.

What is bringing Menendez down is Corzine. Survey USA's recent approval ratings for the Governors show Corzine is approaching Bush numbers.

I think it's a combination of Jon Corzine (aka Jim Florio II-The Sequel) and a backlash against the amnesty protests.

I'm sure CF did not imply that Menendez's family was illegal or anything of the sort, but that he merely pointed out that the recent immigration protests have brought about a backlash against liberal Democrats, and particularly Hispanic liberal Democrats. I don't know if CF is correct about the immigration protests being the main factor swinging the polls a bit towards Kean, but it might be one of several factors.

BTW, while you are correct that refugees from Castro's regime get automatic asylum once they reach our shores, Menendez's parents emigrated from Cuba to New York over a decade before Castro took power (Senator Menendez was born in NY in 1950 or so), so they did not have the benefit of the preferential policy. I'm pretty sure his parents emigrated legally, though.
