House Passes NRA-Backed “Disaster Recovery Personal Protection Act”

Fairfax, VA-The National Rifle Association (NRA) and law-abiding gun owners won another major victory today when the U.S. House of Representatives voted to pass HR 5013, the NRA-backed “Disaster Recovery Personal Protection Act”. HR 5013 passed with a broad bi-partisan margin of 322-99.

“Law-abiding gun owners scored a significant victory in the House of Representatives today,” said Chris W. Cox, NRA’s chief lobbyist. “The aftermath of Hurricane Katrina confirmed a fear long-held by American gun owners: the day government bureaucrats declare our Second Amendment null and void, leaving law-abiding citizens defenseless in the midst of chaos and lawlessness.”

This is the second NRA win on this issue in less than two weeks. On July 13, 2006, Senator David Vitter’s (R-LA) amendment to prohibit the use of funds appropriated under the Homeland Security appropriations bill (H.R. 5441) for the confiscation of lawfully possessed firearms during an emergency or major disaster passed the United States Senate with a final vote margin of 84-16.

H.R. 5013 amends federal emergency statute laws to prohibit federal, state and local authorities from confiscating lawfully owned firearms during times of national emergencies, as witnessed in the aftermath of Hurricane Katrina last year when police and military confiscated firearms from law-abiding citizens.

“No matter what the circumstances, lawful gun owners have the right to possess their firearms in their homes,” continued Cox. “And if forced to evacuate, they have the right to transport their firearms to a safe place. Nobody has the right to disarm them. That’s what this legislation ensures.”

After witnessing the draconian confiscation of firearms from law-abiding residents in New Orleans, Alaska, Idaho, Florida, Kentucky, Mississippi, New Hampshire, Oklahoma, South Carolina, Virginia and Louisiana passed measures that echo the spirit of HR 5013.

“On behalf of our four million NRA members nationwide, I want to thank Rep. Bobby Jindal (R-LA) for introducing this legislation and the House Republican leadership for seeing that the ‘Disaster Recovery Personal Protection Act’ got a vote on the floor of the House of Representatives,” concluded Cox.

House votes to block some gun-seizing

322-99, less than half the dems in the House had the gonads to oppose this bill. Here's the roll call vote.

It appears that the gubment has assumed the authority. They can now take them away.

The sponsor of the bill is the same Bobby Jindal who ran against Democrat Kathleen Blanco in the 2003 Louisiana gubernatorial election but, unfortunately, lost.

Following Blanco's dismal performance following hurricane Katrina, bumper stickers began to appear on cars with the caption "Dont' Blame Me. I Voted for Jindal."

The Republican Jindal, the son of Indian immigrants and a convert to Catholicism, is running for re-election in November and may be considering a rematch with Blanco next year. If the latter is true, let's get it right this time, Louisiana, and bring a conservative (and a darn smart guy to boot) to the Governor's Mansion.

You are entitled to your view. Most of the rest of us are of the opinion that the feds have just made it clear, i.e. they've left no excuse or crutch to lien on for the gun-grabbers, that such actions are forbidden. Yes, the 2nd Amendment protects our pre-existing RKBA, but unfortunately some didn't recognize its authority and aggrieved gun owners had to suffer the violence and indignity of having their guns seized, and then go to court to get them back. This law (assuming GWB signs it, and he will) should act as a condom to prevent similar actions in the future.

They assumed the authority during Katrina. Whether that was legal was questioned. This just insures they won't be able to do it again. What is so hard to understand about that? Why do you feel the need to twist it into something it isn't?

How does this ensure they won't be able to do it again? Will police officials who do this unlawfully be arrested and imprisoned? I haven't seen the text of the bill.

A law is worth only the paper on which it is written. The 2A was written on mighty fine parchment and is moot. This bill is written on disposable printer paper.

The 2A 'shall not be infringed.' ALL else regarding guns is slippery slope.

I did not intentionally twist anything. Just an observation.

While I generally don't like much of what comes out of Wash DC, this law is a necessary evil.

I have to refer to post 18. What guarantee do we have they won't do this again - none.
