Off-Duty Dekalb Officer Kills Home Intruder (good news)

CHAMBLEE, Ga. (AP) -- DeKalb County police say an off-duty officer shot and killed an intruder who broke into his apartment at Chamblee while he was sleeping.

Police believe three men broke into the man's home at Lake Louise apartments about 2 am and say the officer was inside. His eight-year-old son also was sleeping in the apartment.

Police spokesman Herschel Grangent says the officer awoke, saw the men and saw one of them pointing a gun at him. The officer shot and killed the man. Grangent says the officer was defending himself.

The man's son was not injured.

The officer is on routine paid administrative leave while authorities investigate the shooting. He had been on the force for about five years.

Grangent says authorities have not determined whether the officer used his service revolver or a personal weapon. They do not plan to release the officer's name.

Several things not mentioned in the story that have subsequently come to light
  1. This is in the heart of Cynthia McKinney territory
  2. The home invaders were black males in the 17 - 20 range (big surprise there)
  3. One of the robbers' uncles identified the crew to the police
  4. There were four of them
  5. The family of the dead thug is saying that he shouldn't have been shot because his gun wasn't loaded (like the cop would know that?)
I am as critical as anyone of police excesses, but in this case the cop got it almost EXACTLY RIGHT (the only thing he could have done better would have been to get more of them). It's good to see that Cynthia's homies aren't taking the surge in violent crime committed by illegal Mexican invaders lying down (the upsurge in home invasions in neighboring Gwinnett county this year have been mostly commited by hispanics), and that they're doing their part to ensure that young black males continue to lead the demographic for violent criminals.

Of course there is the usual garbage from the family of the dead thug as in "Why did he have to die?" and "he was a good boy that made a wrong choice." and better yet "The cop was waiting for him" Well duh. When the cop heard the a$$holes breaking down his door what should he have done? Thrown down his gun and begged for mercy? Ambush the a$$holes - If they've broken down your door in the middle of the night and are armed, you can probably assume that they're not looking for a fifth person for a pickup game of midnight basketball. What you can assume is that they're there to hurt you.

Even the radio reporter on the liberal Cox 750 news this morning managed to make a comment to the effect that what did he expect, breaking into a guys apartment and pointing a gun at him?

Kudos to the anonymous DeKalb cop for cutting the career of violent thug short. Although if it had been an ordinary citizen would the police protected his identity? Somehow I doubt it.

Or anyone else's in GA. I asked both my wife and kid (kid is adult) what they'd do if they heard someone breaking in. Wife said call cops. Kid said aim at center of mass and open fire before they figured out where you were then call cops after. Guess which one got the answer right?

Let me clarify my previous post:
Are the thugs who broke into the officer's home liable
to be charged with felony murder since a death (albeit one of their own) occurred during the commission of a felony?

What does this have to do with him being a police officer?

It seems a simple case of defending one's home.

He was acting in the capacity as a private citizen, not a police officer.

In Georgia, you do have the right to consider an intruder in your home a deadly threat, do you not?

That varies from state to state. Not being a lawyer I don't know if that's on the books in GA. If it were then I'd say yes.

You sure do. The media were making a big thing about his being a cop and the police were keeping his identity hidden because he was a cop - something they'd NEVER do if you or I had defended ourselves in such a fashion. Just another case of some animals being more equal than others.

That's the one I prefer. My wife said well you two are certainly bloodthirsty. I said no - just realistic, and I hope that neiher one of us ever has to depend on you in that sort of a situation. She shut up, but you could tell her liberal yankee upbringing was still there :-)
