Yep, it’s called “felony murder” and it is the risk you take when you participate in a scheme that deliberately puts victims’ lives in jepoardy. Fry, string up, shoot, or stick him as just punishment and an example to others of his kind.
The law sounds fine to me. The perp should have started running away and shouting at the top of his voice when he realized that a crime was about to be committed. Then, I could see some sympathy for him but he did nothing.
