Lawyer: Feds Violated Kerik's Rights in Probe

Bernard Kerik's lawyer says federal prosecutors have violated his rights in his corruption case by improperly questioning his former lawyer.

Attorney Kenneth Breen asked a judge to consider whether legal action was warranted in light of his claim. Kerik was police commissioner when Rudy Giuliani was mayor and he was recommended to be head of the national Homeland Security Department. He was pleaded not guilty to lying to the White House, filing false income taxes and other charges in a wide-ranging federal indictment.

The judge is also considering whether Breen should be disqualified as Kerik's lawyer because he too could be called to testify.

Prosecutors say Breen knew about false statements Kerik made during an earlier probe into renovations to his Bronx apartment. Kerik pleaded guilty to a misdemeanor charge of accepting an illegal gift. Prosecutors maintain Kerik's statements amounted to obstructing justice and so aren't subject to attorney-client privilege. They have not accused Breen of acting improperly.

Prosecutors have also said they plan to call former Kerik lawyer Joseph Tacopina as a witness to testify about the statements.

Breen said in court papers that prosecutors wrongly questioned Tacopina, breaching Kerik's rights. Breen also said removing him from the case would raise issues of fairness.

Kerik was police commissioner when Rudy Giuliani was mayor amd was recommended by Giuliani to head Homeland Security.

EDITED: Kerik was Giuliani's bodyguard and driver before Rudy promoted him to NYC Police Commissioner (a job for which Kerik was clearly unqualified).

And---surprise---Kerik was the obedient yes-man who okay'ed Rudy's security demands for his mistress, assigning seven NYPD officers, police cars and drivers to be at Jooty's beck and call 24/7........

Yeah, Kerik. The same guy who flopped as Homeland Secy nominee.

Giuliani recommended Kerik to Pres Bush to head Homeland Security which would have been a money-making machine for Giuliani's global security businesses-----not to mention Kerik's unlimited access to FBI files that the two conspired to turnover to Giuliani to advance Rudy's political ambitions.

Giuliani's clients paying through the nose should note that Giuliani's so-called "security expertise" failed to uncover Kerik's illegal alien, and tax problems---Kerik later pled guilty to having mob ties and to receiving illegal emoluments from city contractors.

Kerik is now charged in a wide-ranging federal indictment including filing false income taxes and lying to the White House on official forms. (Who helped you to fill out those WH forms, Bernie? Your pal Rudy?)

WILL A PUTATIVE PRES RUDY PARDON KERIK AND GIVE HIM THE HOMELAND JOB?

Bernie is such a troublesome client. Tacopina defending John Gotti was an easier job -- much less public whining.

You know (excuse the Hillaryism), that little tidbit is always left out when Rooty spouts his

Well yeah Rooty - DUH. The 'NYPD' was your boot licking lackey Bernie. He'd give you anything you asked for (off the record) or hinted at. Plus Bernie being an amoral degenerate like you knows that 'Discretion is the better part of Valor'(sarc) when it comes to protecting mistresses.

So a shiny new Kewpie Doll goes to the first (cough) reporter who asks Rooty about the coincidence of Bernie, the protection he ordered and the NYPD bookkeeping. One thing's for sure though, they won't be from Fox.

Rudy constantly has to deal with those horrid questions about whether or not his presidential administration will be more transparent (re his funding his mistress' security detail by billing obscure city agencies to hide it from public view).......

Good thing Rooty has the answer memorized and is able to repeat it by heart, even in his sleep..........and I quote.

"I'm just a great 9/11 guy who made a lot of mistakes but everything was revealed and transparent in my hugely successful 9/11 mayoralty where I slashed taxes, crime, squeegee men and litter 9/11."
