It's sad to say, but I doubt the judge is going to grant this. General Hagee, probably, but not Murtha. I can't see any Judge wanting to get involved with a case of possible Congressional Immunity. All Murtha has to do is say it was a political statement and 'poof', immunity.

It's like Patches Kennedy crashing his car into the barricade at the Capitol building. He just had to say "I'm going to a vote" and he's free. Same thing.

IANAL, but I believe that even political statements are only covered under Congressional immunity when they are made in the course of conducting the business of his office.
