They should claim that they are producing ethanol to help relieve dependence on foreign oil (moonshine is mainly ethanol....and, hopefully little else).

That argument sounds ridiculous, unless you consider how many judges are flaming liberals and would buy that argument.

See my post #10. A number of folks ARE making ethanol for fuel, and it IS legal, if you get all the proper permissions and pay the required road usage taxes.
