Court: Mumia Deserves New Hearing Mar 27 10:02 AM US/Eastern PHILADELPHIA (AP) - A federal appeals court has ordered a new penalty hearing for celebrity death row inmate Mumia Abu-Jamal (moo-MEE'-ah AH'-boo jah- MAHL').

The 3rd U.S. Circuit Court of Appeals says Abu-Jamal's conviction for the 1981 murder of a Philadelphia police officer should stand. But it says he should get a new sentencing hearing because of flawed jury instructions.

If prosecutors don't want to give him a new death penalty hearing, Abu-Jamal would be sentenced automatically to life in prison.

A Philadelphia jury convicted Abu-Jamal of killing Officer Daniel Faulkner after the patrolman pulled over Abu-Jamal's brother in an overnight traffic stop 27 years ago.

what do prosecutors have to lose?

life sentence with no parol or death.

seems the judge just made a grasping at straws technical ruling.

What were the specific “wrong instructions?”

Mumia can now be exposed to the family AGAIN parading in front of a judge or jury.

This piece of trash has stayed alive for more than a quarter century, 27 YEARS, since the night when he shot a young Philadelphia police officer, Daniel Faulkner, multiple times.

Leftist bozos have kept this fraudulent issue going for so long, when the only question should have been carrying out the sentence.

The life sentence is what the cop-killers what him to have. He deserves to fry! More than likely, not going to happen now. I would accidentally strap him to a gurney and pump him full of windex and write it off as a bureaucratic mistake.

Does anyone know which prosecutor’s office has jurisdiction on this case?
