Do Obama's Recent Fundraising Letters Violate Federal Anti-Gambling Laws?

The Obama campaign has already been warned by law enforcement agencies against running "Backstage with Barack" and "Dinner with Barack" lotteries in Minnesota and possibly Colorado. Minnesota's Department of Public Safety counseled Obama for America to provide a means of entering to win a chance to meet Barack Obama without making a donation, which would remove the "payment of consideration" element that makes the scheme an illegal lottery. The Obama campaign agreed to do so, but it apparently broke this promise as of October 31 2008.

We are not attorneys and cannot give legal advice, but Missouri's definition of illegal gambling is typical of that in most states. Bracketed material relates these definitions to Friday's E-mail from the Obama campaign, "Will You Join Me on Election Night?" We have meanwhile received three similar E-mails since then...

    Three elements make up an illegal promotion:

    1. Prize is any benefit, cash or property awarded to a winner. ["If you're selected, you can bring a guest, and we'll fly you in and put you up in a hotel for the night. You'll go backstage at the big event..."] 2. Chance means the winner is chosen by “luck” with little or no skill or ability involved. ["If you're selected..."] 3. Consideration is the exchange of something of value for the opportunity to participate in the game. ["Any donation counts -- whatever you can afford. Show your support at this crucial time with a donation of $5 or more, and you could join me on Election Night"]

In addition, Federal law prohibits illegal gambling.

    U.S. Code Title 18, Chapter 95 ("Racketeering"), § 1955, " Prohibition of illegal gambling businesses"

    (a) Whoever conducts, finances, manages, supervises, directs, or owns all or part of an illegal gambling business shall be fined under this title or imprisoned not more than five years, or both. (b) As used in this section—

    (1) “illegal gambling business” means a gambling business which—

    (i) is a violation of the law of a State or political subdivision in which it is conducted;

    (ii) involves five or more persons who conduct, finance, manage, supervise, direct, or own all or part of such business; and

    (iii) has been or remains in substantially continuous operation for a period in excess of thirty days or has a gross revenue of $2,000 in any single day.

    (2) “gambling” includes but is not limited to pool-selling, bookmaking, maintaining slot machines, roulette wheels or dice tables, and conducting lotteries, policy, bolita or numbers games, or selling chances therein.

    (3) “State” means any State of the United States, the District of Columbia, the Commonwealth of Puerto Rico, and any territory or possession of the United States.

    ...(e) This section shall not apply to any bingo game, lottery, or similar game of chance conducted by an organization exempt from tax under paragraph (3) of subsection (c) of section 501 of the Internal Revenue Code of 1986, as amended, if no part of the gross receipts derived from such activity inures to the benefits of any private shareholder, member, or employee of such organization except as compensation for actual expenses incurred by him in the conduct of such activity.

As far as we know, Obama for America is not "an organization exempt from tax under paragraph (3) of subsection (c) of section 501 of the Internal Revenue Code of 1986, as amended." We are not attorneys and cannot give legal advice on how this law may apply to the Obama campaign's four recent E-mail solicitations, all of which include the following elements:

    (1) Payment of consideration (a donation of $5 or more) as a condition of entry, noting that none of the letters nor the Web pages they reference say you can enter without making a donation (2) An element of chance ("you may be selected") (3) A prize ("we'll fly you in and put you up in a hotel for the night. You'll go backstage at the big event")

Seems to me a clear violation of 18 USC 600.

“Whoever, directly or indirectly, promises any employment, position, compensation, contract, appointment, or other benefit, provided for or made possible in whole or in part by any Act of Congress, or any special consideration in obtaining any such benefit, to any person as consideration, favor, or reward for any political activity or for the support of or opposition to any candidate or any political party in connection with any general or special election to any political office, or in connection with any primary election or political convention or caucus held to select candidates for any political office, shall be fined under this title or imprisoned not more than one year, or both.”

only if 0 looses on Tuesday and even then it's doubtful. If any laws were applied to 0 his supporters would be threatening to riot in the streets and neither W or McLame have the testicular fortitude to do what it would take to investigate and punish 0
