An Oak Cliff man is thankful he is alive after a teenage burglary suspect tried to shoot him. The man, who lives in the 300 block of Hobson Street with his mother, came home Wednesday morning to drop off a newspaper when he found the front door kicked in, Dallas police said. Seventeen-year-old Gabriel Flores, who was inside the home, pulled out a handgun and fired at him. The son, who has a concealed handgun license, fired back and struck Flores, who later died at a local hospital. He shot at me four or five times and thank god he missed, Charles Bircher told KTVT-TV on Wednesday. It was a matter of life and death. Bircher's 79-year-old mother, Ivy Willis, told KTVT-TV she supported her son's actions. I would've done the same thing, she said. Burglars just want to break in and take what everyone else got, she said. Officials said the case will probably be referred to a grand jury.

It is good to see that the good guy won. Last weekend hubby and I took our CHL class and the instructor said shootings always go to trial. He said get yourself a good lawyer and when their attorney asks “Did you mean to kill or injure my client ? “ we should answer I only wanted to stop him.....
A grand jury? Certainly with forensics they can determine how many shots were fired by the perp and where they landed, and they have the witness testimony. I would think that would be enough to decide.
Don’t forget to say “I feared for my life” every other sentence.
hope it works out for him. in 3 out of the 4 different “personnel defense” courses I have completed, discussions of costs defending yourself in a what eventually turns out to be a correct use of deadly force scenario was shown as just hard to believe.
just from the facts as presented, i can’t see how they can recommend that it even go to the grand jury.

I think that’s meant for the jury to “no-bill” him, which would strengthen his case should the perp’s family try to sue in civil court.
Kid was “just turning his life around” and all that, I’m sure. [rolling eyes]
Still, the homeowner shouldn’t have to worry about it at all. In defending himself from the “justice system,” he’ll spend more than the rotten little turd could have carried off in one afternoon.
