WHOSE SIDE? Cass Sunstein's theories on cost-benefit analysis align him more with conservatives, critics say. Cass Sunstein, selected to be Obama's regulatory czar, has labor activists and environmentalists digging into his record.

Reporting from Washington -- Harvard Law School professor Cass R. Sunstein, a widely admired intellectual and friend of President Obama, has spent years delving into the obscure issues of regulatory law and behavioral economics.

Though he is generally described as left of center, Sunstein's academic interests in regulation have led him to raise questions about the constitutionality of liberal favorites such as workplace safety laws and the Clean Air Act. He has embraced a controversial "senior death discount" that calculates the lives of younger people as having a greater value than those of the elderly.

Let’s not forget Sunstein wrote Republic.com in the late ‘90s, a thinly veiled attack on this website, Free Republic, in which he made the ludicrous policy proposal that political websites of every hue be forced by legislation to provide links to all views that might be construed as oppositional to those proffered on the site.

Sunstein is a liberal with a strong bent towards gov’t regulation. The stuff I’ve read in the last few days suggesting that he’s a closet conserative strikes me as absurd.

That's right! I did not read Republic.com but I did hear a couple of long interviews with the author when he was promoting the book. The Nytimese and other lefties absolutely loved the book.

Sunstein is more modest, calling on government to require political web sites to post links to sites with opposing points of view. Thus freerepublic.com would be required to make available an icon pointing to aclu.org. This would be government's attempt to create a public forum in which individuals encounter unexpected and unwelcome points of view.

He also wrote the book “Nudge” which argues for “libertarian paternalism.” I wrote a paper criticizing it in college and my professor blasted me for it...which I expected from “academia.”
