President Obama Likely to Order Military Commission Charges Dropped Against Terrorist Suspect

ABC News has learned that on Friday, President Obama will likely order the Department of Defense's Military Commission to withdraw charges against terrorist suspect Abd al-Rahim al-Nashiri. The charges may later be reinstated in a military commission or pursued in a civilian court. Al-Nashiri will remain in custody.

The announcement will not be made until after President Obama meets with the families of victims of terrorist attacks on 9/11 and on the U.S.S. Cole, where he will assure them that this step is not being done to be lenient towards al-Nashiri. The move is being done to stop the continued prosecution of al-Nashiri in a court system that his administration may ultimately find illegitimate, not for any other reason, sources told ABC News.

President Obama has expressed concern about whether the military commissions set up by the Bush administration are the proper way to go forward in pursuing charges against the U.S. detainees, and on January 22 he asked all the judges supervising the trials of detainees for a continuance of 120 days, so a team of administration officials could review the best way forward.

In almost the cases, that continuance request was granted. But last week the judge supervising the al-Nashiri trial -- Army Col. James L. Pohl, the chief judge at the Guantanamo Bay war crimes court -- said he would not heed President Obama's request for a 120-day continuance, or delay, in prosecutions of terrorism suspects. Pohl called the president's request "not reasonable" and not "in the interests of justice."

The arraignment of al-Nashiri is scheduled for Monday, February 9.

obama is hoping for another attack. Then he can and will declare marital law, incercarate his political enemies and complete his agenda. He will have succeeded. That should warm the cockles of those on this forum who have said, via thir posts, that they want him to succeed.

Obama keeps saying his administration may find this legal proceedings illegal but it's the same system that congress already gave extended rights to the detainees.

You are free to blame whoever you want. But the Republican party probably should have put up a proper candidate and then it wouldn't have been a worry.

Not to insult you, Arkinsaw, but everytime I see this point of view expressed on FR, I want to tear my hair out. Why? Because it just screams ignorance of how our political system works.

Parties do not select candidates to run in primaries. Candidates select themselves, partially due to their own ego and belief they can make a difference, and partially due to encouragement from family, friends, and associates.

Parties do not elect candidates in primaries. Voters do.

If you want better candidates in the primaries, you can either: (1) run yourself, (2) find a viable candidate you like, do it well before the primary season begins, and help that person get on the ballot, or (3) if your state has open primaries, get involved and work to return to traditional closed primaries. Other than having a political point of view you agree with, someone is a viable candidate if they can raise funds to run a potentially winning campaign, and if they can craft a message that appeals to a sufficient number of voters.

As President Obama prepared to order the Department of Defense’s Military Commission to withdraw charges against terrorist suspect Abd al-Rahim al-Nashiri on Friday afternoon, the convening authority for the Commission, Susan Crawford, withdrew the charges on her own Thursday night.

The charges were withdrawn without prejudice, meaning they later can be reinstated in a military commission or pursued in a civilian court. Al-Nashiri will remain in custody.

The original plan was for the announcement not to be made until after President Obama meets with the families of victims of terrorist attacks on 9/11 and on the U.S.S. Cole Friday afternoon, where he will assure them that this step was not done to be lenient towards al-Nashiri.

if I were a family member of someone killed on the Cole, I’d refuse to shake his hand or listen to him, IF IF IF I decided to go at all..

this guy has me pi**ed, I can’t imagine how the families feel..

Not so fast. In case you aren't looking, his popularity numbers have dropped in the 2 weeks he has been president and the people are beginning to wake up to their inexperienced, immature, amateur President-in-Training.

He's trying to get Porkzilla passed and the information seems to be that the support isn't there. As more Americans learn what is in this massive spending handout bill, more and more of them oppose it. Even the DBM is beginning to ask the questions they should have been asking during the campaign.

If the Obamoron is willing to "fall on his sword" to try to bulldoze Porkzilla through the Senate and, especially if he manages to succeed, he will spend the remainder of his one and only term in office trying to regain the trust and support of Americans.

As it is, a growing number of people are paying closer attention to his cabinet picks and all of their tax or other corruption problems. Barring the potential that someone in the House will prefer impeachment charges against him, if he tries to declare martial law, he'll quickly discover that he will have overplayed his hand.

All that time spent voting "present" is coming back to haunt him and prove beyond a doubt that reading speeches written for him by others off of a teleprompter doesn't prepare one to be the President if the United States. He wasn't ready to lead when he began his presidential campaign, he wasn't ready to lead on 1/20/09, and he isn't ready now.

Personally, this writer would love to be in the room when Obama talks to the families of the Sept. 11th 2001 and October 12th, 2000 USS Cole terrorist attacks when he breaks this news to them. If it were me, there would be no amount of Secret Service that could get between myself and Obama when I choke the living shit out of him for this bumbleheaded move.

Obama is about to cause all this controversy so he can politically grand-stand for the extremist left-wing nutjobs while simultaneously causing untold pain for the families of Sept. 11th and the U.S.S. Cole bombing because he's "concerned" about the legality of the military commissions setup under the Bush administration.

What a dope. Al-Nashiri is a Saudi, which means he will likely be tortured if returned to Saudi Arabia,

So we can't send him to Saudi Arabia.
Nobody else wants him.
Bringing him here makes him a "US person," which means he cannot be held without trial.
With the defense using civilian, peace-time rules of evidence, a conviction will be impossible.

Which means he will end up on welfare or driving cab.

Obama is an idiot.....or maybe....I won't say it, but if he keeps it up....

The voters are the Republican Party...they chose a candidate I simply could not support and who had, for years, shown antipathy to my concerns and even flirted with joining the other side. What is there to get frustrated about there in regard to what I said?

The Republican Party can return to Reaganism and then they will get my vote...as well as the votes of many Democrats. Nothing difficult about that statement either.
