How low can you go? I believe in paying one's bills, but this is over the top!

it gets worse than that. They’ll randomly call anyone with the same last name as the debtor and demand payment. I’ve received collection calls for people I’m unrelated to.

Oh! But they help to mitigate “brand risk” for the companies trying to collect from the relatives of the dead...look at how very nice their website looks.

While most people on this website understand that such calls need to be referred to the Estate attorney; many of our fellow citizens may be deceived. It is really despicable.

Years ago my girlfriend ran up large credit card bills and was killed in an auto crash. Since we lived together, the CC people called me, threatened me and I knew I was NOT responsible for any of her debt. I’d tell them they were welcome to come get whatever she bought as I was going to give the clothes to the Salvation Army. That made them quit. I did, however, run across a lot of stuff still in store packages that I took back, credited her account and lowered her bottom line. So, this is not something new. Never promise to repay anything you are not legally responsible for. After that first payment, YOU have assumed responsibility.

Another thing that is happening is con artist are sending estates fictitious bills hoping to get the estate to pay for a purchase or service that was never contracted for.

My wife’s uncle died and this is what happened. We just told them to file their complaint with the court, and get a court order for payment. It never happened. All legitimate bills were paid of course.

Survivors owe zip. I think, though, if there is an estate, it needs to make restitution of all just debts. It's been a bazillion years since I took any law classes, but I seem to remember that as first on a will, even if the will is written by statute by the state.

I don't have much use for a lot of laws but in this case I most definitely think that federal legislation needs to go through to stop this travesty.

Debt collectors are low-life scum not worthy of life. These scum-sucking leeches have harassed me for years, trying to collect a debt from a person with my name. They engage in harassment and violate numerous federal and state laws.

I’m preparing a lawsuit against these crooks. I can’t find an attorney who will take the case because these shysters work with the scum-sucker collection agencies.

I hate filing civil lawsuits - it’s a big time consuming process.

Um, that’s the law. Probate estates pay exempt assets to the family, then taxes and expense of administration, then the just debts of the deceased (the executor publishes notice and reviews all claims first), and anything left over goes to the heirs. When did this become bad all of a sudden?

When my husband was alive, I suspected he was running up debts behind my back. When I tried to investigate, the credit companies told me they couldn’t give out any information, since it was none of my business.

Then he died, all his secret debts came to light. Those same companies came after me to pay up.

It felt great to tell them to take a hike.

My brother-in-law recently died and left substantial credit card debts. He had used his credit cards to pay the large medical bills he incurred during his long illness that were not covered by his insurance. He didn’t own a home and his only assets were a ten year old pick-up truck and a boat. Neither I nor my wife feel any obligation to pay his debts neither do we have any legal obligation to do so.

Someone has to pay for the lavish parties bankers throw for each other.

Las Vagas bashes aren't free after all...

Who's easier to shake down than a grieving widow? Yeah, I really love bailing out bankers...

They should have every right to go after the estate but not after the familys own assets unless they were turned over to them before death in an obvious ploy.

This is nothing new.

Yeeeeeears ago when my mother died, I got a call from on of these slugs. It was for an 'outstanding' hospital bill of a couple hundred bucks.

I told them, and not exactly nicely...

"Well, guess you'll have to sue my mother for it, but she's DEAD! So lot's of luck serving those court papers in heaven."
I hung up and never heard another thing from them. Maybe they're just a bit more aggressive now. But its nothing new.
