Finally, a small victory in our battle against CNN, and their abuse of the DMCA take down procedures.
Today we received the following message from YouTube:
In accordance with the Digital Millennium Copyright Act, we’ve completed processing your counter-notification regarding your video http://www.youtube.com/watch?v=Dd2tg8gxCDU .
This content has been restored and your account will not be penalized.
Sincerely,
Harry
The YouTube Team
Below is the clip that CNN fraudulently forced YouTube to take down, in a vain attempt to silence us.
Very big thanks goes out to our attorneys at EFF and David Adler!
We also want to thank Ben Sheffner, Patterico, Michelle Malkin and Instapundit for all of their efforts and support though this part of the process of defending our rights.
We also want to thank YouTubers Fearblocke and themaskedanalyst for their support, as well as the hundreds of others who chose to upload the clip into their accounts in defiance of CNN’s attempt to silence embarrassing criticism.
The only questions left are…what now? What comes next?

I’m glad they restored your video, it takes fighting back, I had 2 phony copyright claims from “The Young Turks” on my youtube account, they had nothing to do with my videos, I fought it, and I received a similar e-mail saying my account has been restored to previous status....that’s good news, because I’ve had 2 accounts permanently suspended on youtube
oh by the way, If you want to see how it’s absolute leftists running youtube, look at tpmtv, youtube.com/tpmtv (talkingpointsmemo, a left wing blog) they have 1600 videos, 1200 are copyright violations, not only do they upload them, they sell ads on them...My account, speakmymind01 was suspended for uploading Obama videos from NBC
Its there but I had the same view count on two different computers 231981. Anyone else see this?
Bravo. Great video by the way. I hadn’t seen the second half before.
Why did that old guy stop him from talking? That was beyond rude from what I seen.
CNN just didn’t want their brain dead hired hand gunslinger to be outed for biased gutter-snipe she was.
The point made about this not being anti-Democrat any more than it was anti-Republicans was the crux of the matter. We’re angry at all of them. The left, the right, Bush, Obama, we’re sick to death of the theft of our hard earned money.
“Toss them out” should be our battle cry. It’s long overdue.
Have guests I must attend to, but will closely look over all the hyperlinks you've posted, will get up to speed later.
At first glance though looks like the CNNlings tried pulling a fast one with (?) UTube's cooperation?
Scoundrels!
Can't wait to get back, sounds like *trouble*. :o)
Said in a sharp acerbic voice by Susan R. How typical; ask a question and do not wait for an answer. Then interpose like an interrogator, so indicative of the mode of so-called journalism. How these people have honed this style over the years. That goes for Canada as well, with CBC's polite thinly veiled sarcastic tones and their snickers. It is obvious the woman journalist had not the slightest intention of hearing a person out. Cutting them short, before they could make a follow up point.
People are beginning to wake up to the provocative approach of the media.
WTH's going on here, Mil?FR threads pertaining to the Susan Roesgen teaparty incident. In a nutshell CNN hoped to set a precedent by demanding that youtube pull an embarrassing video. A video that every conservative and his brother had already downloaded BTW. CNN authoritarians tried to use intimidation to appropriate gatekeeping powers over youtube and the Inet.
Thanks Milhous.
The motivational speaker I heard last Saturday called CNN “Constant Negative News.”
Okayyyy, the CNN imbecile. Shameless shill. Snotty, arrogant and on TV. Made me want to snatch the wench by her throat & CTS outa her.
Had I the time yesterday for one glimpse of the video I wouldn't have had to ask you such a silly question. :^)
"In a nutshell CNN hoped to set a precedent by demanding that youtube pull an embarrassing video. A video that every conservative and his brother had already downloaded BTW. CNN authoritarians tried to use intimidation to appropriate gatekeeping powers over youtube and the Inet."
Now there's a shocker.
As they say, who knew.
Alright then, we're celebrating some kind of "victory" won at/over CNN and their *pals* at YouTube???
That right?
Considering what poster "talkradio03" said in posts 4 & 5? This victory, while I'm glad 'bout it & all? Isn't it somewhat Pyrrhic?
I say that only because the leftist UTube leakers seem to have a track record censoring whateverinthehell they don't like, which continues.
{~& no, I'm sure ol' "Harry" will not sort 'em all out. /sarc}
As for the CNN wench, Milhous.
A precedent must be set, and set hard.
I mean has she had to pay in any way? She's still employed, right??
*That* one must be made an example of. Run outa Dodge on a rail and possibly the imbecile-producer who was whispering into her empty head, also.
Otherwise there's "a" victory for "a" victim, and no consequence for the perps.
That oft repeated scenario must change, my friend.
There has to be some pain when people behave poorly, or they're actually encouraged to do said poor behavior(s) again and again and again.
Alright then, we're celebrating some kind of "victory" won at/over CNN and their *pals* at YouTube???IMHO YouTube's role as hosting provider seems relatively irrelevant in this era that offers many video hosting alternatives. This action qualifies as more of a "fair use" victory and guarantees me free unfettered fair use of CNN/NBC/CBS/ABC/et al material regardless of who ultimately hosts my CNN/NBC/CBS/ABC/et alvideo clip.
That right?
I'd totally agree with you there, my friend.
Guess I was kind of wondering why in the world anyone would expect fairness -- or any semblance of fairness, thereof -- from a[ny] concern proved to be decidedly unfair?
"This action qualifies as more of a 'fair use' victory and guarantees me free unfettered fair use of CNN/NBC/CBS/ABC/et al material regardless of who ultimately hosts my CNN/NBC/CBS/ABC/et alvideo clip."
I see.
Interesting.
Is [that] what you see happened here? A "fair use" precedent?
I only ask because I'd always thought whateveritis belongs to whoevermadeit; so, what role exactly does YouTube play, here? More importantly what does UTube owe source(s) of videos or for that matter to those who post sourced video at UTube?
I'd think UTube owes somewhere between very little to nothing.
While comparisons may be made to the headaches Robinson & Co had to deal with here, UTube's still only a website hosting members posting, a full 90% (or more) of which in non-ideological in nature.
Y'know you're so very much more engaged, savvy & up-to-speed with all this video stuff than I.
Makes me feel like a real dunce! LOL
This vicious, condescending, arrogant little ignoramus is precisely for whom this poster was written:

STANDING, applauding, wildly!!
"(Please click on it)"
Whoaaaaaa, click on it fellas.
There's a virtual goldmine of poster material dealing with this tax stuff.
Perhaps the most impressive collection of political material I've seen to date at this website on anyone's bio page, ever. And I been around a while!! :o)
A BIG salute for you, my friend. :^)
