Mother sues hospital for £1.5million for 'missing' baby's severe disability

Last updated at 10:09 AM on 16th July 2009

The mother of a five-year-old boy facing a lifetime of severe disability is seeking a £1.5million payout in a unique 'wrongful birth' case.

Rupert Parsons, who met Prince Harry at a Child of Courage presentation, has to breathe and eat through tubes and will need a lifetime of round-the-clock care.

The youngster was born at Musgrove Park Hospital in his Taunton home town in September 2003 suffering from 'severe, profound and multiple disabilties', including congenital heart defects, a single kidney, a cleft palate and a vertebral abnormality.

His barrister, Robin Oppenheim QC, told London's High Court how the boy's multiple disabilities mean that he spends much of his time in a wheelchair and has to be 'ventilated' via a tracheostomy 24 hours-a-day and fed through a tube.

Mother Franchesca Parsons, 25, bears the 'extraordinarily demanding' task of caring for him, the barrister told top judge, Mr Justice Blair.

Rupert's father, Lee Barrett, suffers from congenital heart problems and his maternal grandmother was born with spina bifida. Lawyers say that given the family history, medics at the hospital should have realised Mrs Parsons' pregnancy was high risk.

A pre-natal scan carried out in May 2003 was reported as showing 'no obvious fetal abnormality', but the boy's legal team say signs of trouble were missed and that more detailed tests would have picked up on his disabilities before the 20th week of pregnancy.

Although Rupert is now a very much loved member of his family, his mother sued the hospital's managers - Taunton and Somerset NHS Trust - arguing that, had she know the truth early enough, she would have opted for a pregnancy termination.

Yeah, I love you but I’d have killed you if I’d known what you were like.

Clearly a grasping and greedy couple.

It must be really special when your own mother sues and tells people you should have never been born. Can you imagine growing up with that?

The woman is evil.

Well, now with the 3-D sonograms, this won’t happen, right?

What would Sarah Palin do?

My daughter was at risk with her second child because her cousin had recently had a Down Syndrome baby. The doctor did the blood test to see if there was any indication of abnormality. My daughter chewed her up and spit her out for doing so. She told her doctor: It’s MY BABY and I already love it. You had no right to check for abnormalities since I already told you I would not abort under any circumstances.

It’s not just what “Sarah Palin” or my daughter would do . . . it’s what would a sane, caring, EMPATHETIC, happily expectant MOTHER do to HER BABY? You don’t murder a baby. Well, SANE people don’t consider a Baby anything but a “little person” (or Foetus) who deserves her/his chance for “Life Liberty and (Property in the original) the Pursuit of Happiness.

If a person is going to be EMPATHETIC how about using some of that on the little unborn baby who is innocent of any wrong doing, no matter what it’s egg and sperm donor have done.

What a quack. She is smiling in the photo, why? Because of the camera or the possible payout? Certainly not because she loves that precious little boy. She is pissed because she could not kill the boy while inside here. Selfish people suck.

She’ll kill him eventually. It’ll be an “accident”.

The love of money is then root of all evil.

So they're suing the doctors and hospital for not investigating further after seeing a normal sonogram?

Unreal...

I agree. May the hand of God make absent his pain while she slowly kills him.

The sane and rationalist folks of the world, some of whom call themselves as devout Christians would call your daughter and others like her naive fools. Had a pretty heated argument with one such group a few back on abortion.

That sums it up perfectly.

So why did she marry and have a baby with a guy like this?

Cute kid. His situation with such a butt of a mother is heartbreaking.
