'Frivolous': Latest challenge of soldier vs. Obama tossed

TAMPA, Fla. – An American soldier questioning the eligibility of President Barack Obama to hold office has had his latest legal challenge dismissed "as frivolous and wholly without merit."

The Aug. 6 ruling by U.S. District Judge Richard A. Lazzara came less than two hours after motions were filed by Maj. Stefan Cook, a member of the U.S. Army Reserve who is seeking a firm determination whether the commander in chief of the Armed Forces is a "natural born citizen," a constitutional requirement for those holding the presidency.

"There was no reasoning, no nothing," said Maj. Cook, who noted previous legal decisions in his case included three or four pages of legal explanations.

"It's ridiculous. They're not even saying why it's frivolous and without merit. You can say that to anything with no justification or reason. That's crap. So much for jurisprudence in this country."

So tell me Judge Lazzara, what criteria did you use to determine Hussein is anything but a islamist sock monkey quisling non-NBC?

Obama was born in Kenya to an unwed mother (hubby still married, so marrieage was not official) under the age of 19. He is not eligible for Presidency, unless he proves otherwise. It's actually quite simple. What is he hiding?

She has a helluva lot more to back up her claims than Obama does that he demonstrated his NBC status. Because Obama didn’t.

When Major Cook's orders were rescinded, that made the case moot, not frivolous. Methinks the judge has an agenda. Wasn't Lazzara a clinton appointee?

Then you have to ask the question, why were his orders rescinded?

That's what the judge in Georgia ruled. This is a different judge that was hearing a different case that Cook filed after his first one was tossed.

Richard A. Lazzara (born 1945 in Tampa, Florida).

Lazzara is currently a judge for the United States District Court for the Middle District of Florida. It should also be noted he was in Private Practice from 1974 - 1986. He served on the 13th Judicial Circuit of Florida from 1988 - 1993, and Appellate judge for the Second District Court of Appeal of Florida from 1993 - 1997. In 1997 he was appointed by President Bill Clinton to serve as a United States District Judge.

Judge Lazzara ruled that Cook’s motion to recuse him was frivolous and without merit. He threw out Cook v. Simtech due to lack of standing.

Because he volunteered for overseas service. His remedy was to unvolunteer. The government recognized that and rescinded his orders. He has no remedy in court. Orly is not a good lawyer.

Good evening.

His remedy was to unvolunteer.

When orders are issued, the soldier cannot "unvolunteer." The government makes the decision, not the individual soldier.

Or, maybe I didn't understand your post.
