On a Thursday night Republican Governors Association conference call with conservative activists, moderated by Erick Erickson of RedState, Gov. Tim Pawlenty broached the possibility of asserting the 10th Amendment to keep Minnesota from fully participating in a health care plan passed by Congress and signed by President Obama. The 10th Amendment reads:

He’d just get run over by Obama’s ACORN Machine.
It’d never get over the “interstate commerce” litmus test. DOA.
Right, and when Conservatives propose anything, they have to jump through their own a&^ holes on detail.
I hope they do. It’s time we kicked them back to DC and tell them to get out of our lives.
Yeah.... Courts don’t give a squat about he Constitution, the game is rigged. When Minnesota starts jailing federal agents for overstepping the 10th, then we will have a 10th, until then, we don’t have anything.
How did the Federal government get all 50 states to lower their speed limits to 55 back in the 1980s? How did the Federal government get all 50 states to raise the drinking age to 21, and to lower the drunk driving limit to .08?
In the same way, all the Feds have to do is say “if you don’t play along with Obamacare, you won’t get any Federal Highway funds. You won’t get any Federal Education funds. You won’t get any Federal funds at all.
When states are self sufficient and no longer are dependent on Federal dollars, then the 10th amendment will have meaning. Until then, we are living in a Statist paradise.
How do all these regulations restricting interstate HEALTH insurance pass the interstate commerce test? NO ONE EVER asks that question.
That “litmus test” only has the weight that the states choose to give it.
Do I believe Minnesota will be the first state to make this happen? No. I don’t think the population base of that state is “conservative” enough to get behind it and support it to the end.
Do I think there are a few states where this type of thing WILL happen? Absolutely... and there is no “litmus test” or any other bull sh-t federal mandate that is going to stop it from happening. The “revolution” is already underway...

It would be interesting to see a few States hold back on federal tax payments, if that’s possible.

BINGO. The politicians always want it both ways.
In this Alice in Wonderland country, the Commerce Clause is only invoked when the measure in question constrains our freedom.
Since most individuals and corporations file directly with the IRS, and most businesses send witholding directly to the IRS, I don't see how that would be possible, with the exception of direct State employees.
The lobbyists who want that restriction get what they pay for. Every time.
just wait for the 1st Red River flood of the year...out come the hands asking for Uncle FEMA.
And so it starts. It will end with a Civil War, we have been here before.
The states can just advertise the address to send IRS payments to. They can get control of a vast amount of the money leaving the state. Of course, they would have to protect their citizens against IRS abuse by locking the agents up.
