This statement was the central thesis of Sunstein's 2006 Yale Law School paper, "Beyond Marbury: The Executive's Power to Say What the Law Is."
Especially shameful, given this and many other statements that were known prior to the vote. Unfortunately, one of my Senators, Voinovich, is mailing it in big time since he's not running again.
