Gov. Duval has to file a letter with the Secretary of State declaring this “an Emergency”!! When the secretary accepts the letter Duval (Yes!We CAN!) can then male the appointment so the legislature did not pass the Emergency clause this strictly comes down to Cadillac Duval’s slavering sycophancy to Obama and the millions of phone calls from Axeldork, Harry Reid etc.
This is an Obama Orchestration and always has been.

Ex post facto has always been interpreted as preventing a legal act from becoming illegal. For instance, they can’t charge you with a crime tomorrow for an act you did today that was legal today and not tomorrow.

This is, incidentally, why bills like amnesty are Constitutional (unfortunately) as it does the reverse - making an illegal act legal, retroactively.

Ex post facto would not apply in this case.
