ACORN's Prophetic Lawyer (must read)

ACORN's lawyer warned ACORN 15 months ago to begin fixing its massive internal problems or face certain catastrophe. ACORN didn't listen. It let the problems fester.

The advice from Elizabeth Kingsley of Harmon, Curran, Spielberg Eisenberg LLP came in the form of an eerily prophetic legal memo to ACORN dated June 19, 2008, the day before ACORN's national board fired disgraced founder Wade Rathke.

The memo is a kind of Holy Grail for ACORN researchers. One source of mine keeps a copy in a safety deposit box. I've lost track of how many people have asked me over the last year if I knew how to get a hold of it. One source told me yesterday that there are many people who would "kill" to gain possession of it. This is a bit of an exaggeration perhaps, but not much.

Probably the very result Obama’s handlers were hoping for if he voted ‘present’ on the request. Absolutely every act this man takes, or doesn't take, points to a very few possible end results. What better way to deprive the military of some of its most senior and experienced commanders? They could never ask for the military people to retire or resign, so they do the next best thing by making it very uncomfortable for them to stay in the service.

The actual memo is quite damning and shows that ACORN's own attorneys were very aware of problems.

The fact that apparently nothing was done, even after receipt of this memo, is an extremely important point. It shows that ACORN knew and was advised of possible legal problems and yet still nothing was done. ACORN continued with business as usual and continued to break the law (allegedly). They have no plausible deniabilty.

An organization composed of people with no business or professional management experience can hardly be expected to be well-run or well-managed. An organization that has no respect for the law can hardly be expected to have it’s internal practices stand up to legal scrutiny.

In one of my lives, I read legal opinions provided to me by my organization’s counsel. We take all of these memos very seriously. These memos are crafted carefully to say only what they mean and mean what they say.

But in my experience, I have never been confronted with a memo remotely like this.

“If you do not make some hard choices now and ensure they are carried out, they almost certainly will be made for you.”

If I’d seen this in a memo written to me by my attorney, I’d crap my pants. And take immediate action.

There is nothing “alleged” in ACORN’s law-breaking. There have already been more than fifteen convictions.

Sounds as if she's not an in-house lawyer -- and there's no indication of how long she'd been assigned to ACORN by her firm. She sounds like a real go-getter (possibly one of those liberals who really are idealists -- if immature and ungrounded -- who truly believes ACORN really really only wants to help the poor).

Without further information (which certainly may be forthcoming), I would guess that this lawyer was newly assigned and sincerely wanted to get things with ACORN ship-shape and thought that it was only their lack of sophistication in the business and political world (yes, I know!) that led to such a mess! Which is why she was so honest, and so apparently uninformed heretofore!

I didn't see anything in the article, but does anyone know if ACORN is an actual paying client, a pro bono account, or just deeply discounted?

The real question is how will the leak of this impact the lawsuit Acorn is threatening against Breitbart and the videographers that made the undercover tapes?

I would love to see a trial because discovery of evidence like this will be priceless! The drip-drip-drip of waterboarding that will eventually flood closer and closer to 0zer0.

I think that is most people's experience. The next questions in no particular order:

1. What name/organization will ACORN shapeshift into
2. What are the affiliated organizations
3. How much money, exactly, was given to ACORN and affiliated organizations
4. Who will face prosecution
5. What exact charges will be filed
6. Should a special prosecutor be assigned to ACORN investigatgion
7. Will RICO charges be filed besides the obvious IRS and partisan political federal fund violations
8. Were there other instances of embezzlement that haven't been discovered (I'd bet on it)
