Lawyer asks investigators not to question Hasan

KILLEEN, Texas – The attorney for a man suspected in a deadly shooting spree at Fort Hood, Texas, says he's heading to San Antonio to meet his client.

Retired Col. John P. Galligan says he was retained by Maj. Nidal Malik Hasan's family on Monday. He says he has asked investigators not to question Hasan and doesn't know if he's been medically cleared to talk.

Hasan is accused of opening fire on the Army post on Thursday, killing 13 people and wounding 29 before civilian police shot him. He remains at a U.S. Army hospital in San Antonio, where a spokesman said Monday he is now able to talk.

Authorities won't say when charges would be filed or if Hasan would face military justice.

This creep deserves all the protections the UCMJ offers. Then he deserves a first class hanging.

OK, Hasan’s lawyered up. That won’t change what’s on those videotapes. He murdered people in cold blood. Actions speak louder than any spoken words.

If this disgusting piece of garbage dos not get the death penalty , and have it carried out quickly, he will spend the rest of his life in prison converting other pieces of garbage to be muslim killers.

The money for the attorneys retainer probably came from the Muslim Brotherhood aka Saudis.

I bet Hasan has $13 million bank account in the middle east somewhere.

I’m waiting for the Justice Department under Holder to step in and attempt to co-opt this trial.

I hope the military stands firm and tells him to pound sand.

The only way for Justice to assert jurisdiction is to say that Hasan was part of broader conspiracy - a conspiracy that would meet the guidelines set-forth in the anti-terrorism statutes stemming from the Oklahoma City bombing and 9/11. Holder's not going to do that, ever. The last thing his boss wants is for this to be tied directly to terrorism.

Nope, Hasan will most certainly be facing trial by court-martial under countless UCMJ specifications. It is also my guess that his defense team will craft some kind of affirmative defense to try and spare his life. But, he's not going to beat this rap and a plea of not-guilty would virtually guarantee a death sentence.

Wait a minute, since when can the family declare who the lawyer is? This guy has no ability to agree to have this guy as a lawyer and as far as I know he has not been officially charged with anything. Shot this guy on sight

J.P. Galligan is a retired Colonel, ex-military judge, who has turned stridently anti-military over the last several years since his retirement. His tendency is to believe everything that his client tells him and harangue the court with more unintelligible words per minute than any other military or civilian attorney inside the bar, as if he's getting paid by the word (which, in all honesty, he may be).

The truest form of ammoral hired gun in the lawyer-business.

There is no decision on how Hasan will be tried. Thats very bad news at this point.

While I agree wholeheartedly in what you say, I'm cringing at what I foresee as a complete three-ring circus in the courtroom, lasting several days .. weeks? .. and generating thousands of pages of written transcript at the end of it ...

Since Colonel Galligan retired in 2001, I am mildly curious
as to how Hasan’s family knew to contact him.

He's the biggest grandstanding hired gun within the whole field of amoral defense lawyers in the Killeen/Fort Hood/Temple area ... and maybe in an even wider area than that.

He'd defend Jack the Ripper or Hitler as long as "Mr. Green" makes his appearance before the first session ...

It isn't uncommon for retired JAGS to make their living acting as civilian defense attorneys for military clients. I don't know Galligan, but if I had to guess, I'd say he's probably known at Ft. Hood as frequent criminal defense attorney there. Again, just a guess.

Plus, with the profile of this case, married to the fact that it's a capital case, I'm sure the family has been inundated with offers of representation, both from individual attorneys and organized anti-death penalty groups. It's very common.
