In an article for the Heritage Foundation entitled Congresss Secret Plan to pass Obamacare authored by Brian Darling layout a four step plan for Obamacare to hitch a ride on an existing piece of Legislation which has originated in the House using a rare parliamentary procedure.
Steps one and Two have been completed.

Whoever thinks the megalomaniac House Speaker would defer to Sen. Reid in such a flagrant fashion clearly doesn’t know Nancy Pelosi. The little dance the House and Senate leaders will each do to prove the world, their minions, and their financial benefactors they are not getting “rolled” by the other may yet be the ace-in-the-hole that sends this down to defeat.
Seems to me that this is not unlike the process used to pass Porkulus, which started in the Senate (against the Constitutional stricture that money bills must originate in the House). The Senate gutted a HR that had already passed and been sent to the Senate. They replaced everything after the title and number with the Porkulus text, passed it and sent it ‘back’ to the House. The House then simple passed the Senate version of Porkulus, but now under the title of the originally passed bill.
Pretty shady goings on, IMO. The difference between ‘legal’ and ‘proper’, I’d say.
It isn’t a rare thing. The Senate can’t initiate spending, so any time they are doing their own legislation that includes spending, they always do so as an amendment to some spending bill passed by the house that the Senate has no intention of acting on.
It’s not “common”, because often the house has already passed a bill and the Senate can work on that one, but it is not unheard of, like in this case where Reid didn’t want to start with the hosue bill, even to substitute his amendment wholesale.
This leaves the house bill intact, and on the Senate agenda — theoretically, if the senate bill goes down, the senate COULD simply vote on the house bill, and if they got 60 votes, send it on to the President.
Three card monty from the criminals ....makes me sick. I cannot believe how any of these people sleep at night.
