Possibly in the Senate but not in the House. I've read at least three democrat congressman in the last day who said even with reconciliation it won't pass there and that it's dead. Massa was one of them who claimed they're moving on smaller bills next week. The window for reconciliation closes in the next six weeks, which doesn't leave them much time.

If they had the votes why even bother with the summit since they obviously aren't interested in what anyone thinks anyway.

Great question. Both House & Senate bills contain provisions that would "bind" future "Congresses" in some respects. Most of those provisions have to due the Medicaid Advisory panels that are established and specifying that anything that they decide or determine can only be set-aside or overturned by 3/5th vote of the House.

Every piece of Constitutional scholarship that I've read reaches the same conclusion, that can't be done. It would be a battle, to be sure, but I don't believe these provisions would survive judicial review.

As a practical matter, however, the GOP is going to have a difficult time unwinding this mess because of the Presidential veto. So long as a dem is in the WH, whatever they pass will probably live.
