The content of the any federal version of health care and the procedure used to shove it down our throats is irrelevant. Article 1 Section 8 does not specifically list health care as a power for Congress to regulate and therefore is unconstitutional. The people are not bound to comply with any unconstitutional act of Congress. People need to hammer this point home to their Congress critters!
While I don't disagree with your premise, the Supreme Court has ruled otherwise for almost 160 years. The most famous ruling is US v. Sullivan in the late '40s that essentially cemented the government's authority to regulate at least some components of the health care industry, namely the FDA oversight ability on drugs and drug dispensaries.
The best hope for a Constitutional challenge is against the so-called "public option" and the individual mandate. The Constitution does allow the Federal Government to raise taxes, it doesn't allow it mandate citizens buy something from the private sector, which is precisely what the health care bill does.
