Overregulation: The Senate votes on blocking a government bureaucracy from usurping power never delegated to it by Congress. This administration may put Copenhagen above the Constitution, but we the people have other plans.
The GOP's 1994 "Contract with America," a gift that keeps on giving, hopefully will rescue us once again from the clutches of an unelected bureaucracy, the Environmental Protection Agency, which has been allowed by the Supreme Court to regulate every breath we take and every machine we operate.
When cap-and-tax legislation was introduced in Congress, the Obama administration threatened that if Congress failed to act, the EPA would, using its authority under the Clean Air Act. The Supreme Court has said the EPA has the power, even the obligation, to impose draconian restrictions on so-called greenhouse gases, particularly carbon dioxide.
Then last week, the Senate took up Alaska Sen. Lisa Murkowski's EPA Resolution of Disapproval. It would block the EPA's plan to impose a national cap-and-trade scheme through regulation and not legislation. The resolution has its roots in the Congressional Review Act passed as part of the Contract with America. The Review Act lets legislators veto a "major rule" by any regulatory agency within 60 days of its publication.
The resolution does not speak to the quack science of climate change but merely puts forward the idea that Congress, the elected representatives of the people, and not the EPA, should address an issue with big implications for thousands of U.S. jobs and businesses and freedom itself. Which is fine with us.

Defunding the EPA doesn't fix the problem. Most of the aspects of the Clean Air Act are enforceable by citizen lawsuit. That includes the things EPA does, the things they dont do (check how many EPA air regs are on a court ordered deadline), and ultimately, every permit for every project that has emissions of anything in the US.
The EPA is nothing more than a head-fake and willing punching bag. The way the CAA is written, all they have to do is wait for the inevitable strict constructionist ruling from a court and go from there.
The only solution is revising the clean air act. Anything less than that is pissing into the wind...
And air is not the only thing. Some of the new stuff under water laws mean the rain puddle on your property might be a "jurisdictional water" subject to regulation under the Clean Water Act.
Same issue - citizen enforced by abdication of Congressional responsibility to an unelected beauracracy...
Personally - I don't blame EPA. I blame Congress.

We need to remember the adage stated by somebody (at times it’s attributed to Alexander, Tallyrand, Washington or Napoleon):
“I am not afraid of an army of lions lead by a sheep. I am afraid of an army of sheep lead by a lion.”
We need Rs to control the committees and maintain a majority while our conservatives go to bat to take America back.
We need to develop and support those leading lions. Many are already there in Congress. We cannot put them in positions of power without majorities.
The political reality is that we need RINOs, for now.

Neither legislators or courts have the power to enforce a judgment; that power lies exclusively with the executive branch of government. The complexity of land use issues and the demand for expediency seduces legislatures and the courts to default upon their Constitutional responsibility, to the only civic agency with both relevant expertise and police power. Control of use and, thus ownership of that use, is effectively transferred to the executive branch of government.
Isnt it AMAZING what happens, when you have a President whose brother lives in a hut in Africa? We might as well be led by Idi Amin!
