It sounds like a set up to pin the trial on Jim Bunning...a Republican so that it could be used against him in the next election. Since Bunning comes from a conservative state, this could cost him some votes. Bunning needs to appear at the trial and say, “look the man criticized me but I did not feel harrassed or threatened”.
This could blow up in unning’s face!

FYI: Senator Bunning is retiring this year and it is Dr Rand Paul that is running for his seat (GOP), so I does not appear that he has a "dog in this hunt". So unless these threats were or approached a personal threat threshold, I would say that this is either prosecutor overreach or the equivalent of a
SLAPP suit (Strategic Lawsuit Against Public Participation).

He also is not running for office, he is retiring.
