Feds Prepping Lawsuit Against Arizona Over Immigration Law

The Justice Department could file a lawsuit challenging Arizona's immigration law as early as Tuesday, an official tells Fox News.

The potential court action comes just days after President Obama delivered a speech calling on Congress to tackle a comprehensive overhaul of the nation's immigration system. In the speech, he criticized Arizona's law and warned that national legislation is needed to prevent other states from following suit.

I’m no lawyer, but from what I heard, this law was intentionally written to mirror federal law with the expectation of resistance from obama and holder.

The justice dept will be suing a state over a federal law.

This ought to be interesting to see how the feds twist this one.

So the Federal Government is suing a State Government to prevent enforcement of a State Law based on a Federal Law?

Only in the liberal mind would that make sense.

Gov Brewer should have a press conference with Nungesser from Louisiana and they should discuss the ways in which the Obama administration is making sure that the nation's problems are NOT dealt with.

Feds vs. the States - where have I heard that before?

It’s past time for as many of the States that care to challenge the Feds on the 10th Amendment issue. We’re hanging by a thread here, one SCOTUS Justice.

I understand it has nothing to do with racism or implementation but on fed vs states rights on immigration.

I was wondering if they might go with the angle of jurisdiction or of who’s domain this is supposed to be in.

Of COURSE enforcing immigration law is a federal issue,
but they’d be hard pressed to show how they were fulfilling that duty and therefore obviating the need for the state to do so.

What a FUN case this is going to be. And it WILL be a MAJOR LANDMARK case.

While I am NOT a lawyer I would let the Federal Attorney make his case during opening statements.

I would then agree with all of his statements. Then I would use all of the open source statements made by the Federal Government and various news sources over the last 18 months on this subject.

Then I would state my position: “Your honor, what recourse is left to the state and its citizens when the Federal Government intentionally abrogates its responsibilities as stated in the Constitution and other existing Federal Statues?”

That is the crux of then entire issue. And, BHOI was stupid enough to place it on the table.

While I am uncertain as to how the case will proceed it WILL establish legal precedence for all other cases where the Federal government fails to perform its legal duties. Social Security, highway maintenance, the list goes on, and on, and on....

...on another thread it says that the reson the Feds will use; is that if implemented...the Arizona law will “overload the resources of various federal departments with illegal immigrants to be processed”...../snicker.

You seem to forget that legal precedent means absolutely ZILCH to four of the current justices. Read some of their opinions. They will say whatever is necessary to back Obama. Kagan will do likewise. Seriously. The rule of law means NOTHING to these “justices.” They are on the court for one reason and one reason only, to back the leftist agenda.
