Open-Borders DOJ vs. America

The Obama administration's lawsuit against Arizona, officially unveiled on Tuesday, is an affront to all law-abiding Americans. It is a threatening salvo aimed at all local, county or state governments that dare to take control of the immigration chaos in their own backyards. And it is being driven by open-borders extremists who have dedicated their political careers to subverting homeland security policies in the name of compassion and diversity.

The Justice Department's Civil Rights Division, headed by Assistant Attorney General Thomas E. Perez, took the lead in prepping the legal brief against Arizona. The son of immigrants from the Dominican Republic, Perez is a far-left lawyer and activist who worked for the late mass illegal alien amnesty champion Ted Kennedy and served in the Clinton administration DOJ. While holding down a key government position there in which he was entrusted to abide by the rule of law, Perez volunteered for CASA de Maryland -- a notorious illegal alien advocacy group funded through a combination of taxpayer-subsidized grants and radical liberal philanthropy, including billionaire George Soros' Open Society Institute (not to mention more than $1 million showered on the group by Venezuelan thug Hugo Chavez's regime-owned oil company, CITGO).

Perez rose from CASA de Maryland volunteer to president of the group's board of directors. Under the guise of enhancing the "multicultural" experience, he crusaded for an ever-expanding set of illegal alien benefits ranging from in-state tuition discounts for illegal alien students to driver's licenses. CASA de Maryland opposes enforcement of deportation orders, has protested post-9/11 coordination of local, state and national criminal databases, and produced a "know your rights" propaganda pamphlet for illegal aliens depicting federal immigration agents as armed bullies making babies cry.

In 2006, CASA de Maryland threatened to protest at the schools of children whose parents belonged to the pro-immigration enforcement group Minuteman Project -- and then headed into the Montgomery County, Md., public schools to recruit junior amnesty protesters who were offered school credits for traveling with CASA de Maryland to march on Washington.

As a former Maryland resident, I got to see Perez's militant friends and colleagues in action. I watched CASA de Maryland President Gustavo Torres (who met with President Obama last week) complain that motor vehicle administration officials have "absolutely no right to ask for people's Social Security number or immigration status to get a driver's license." I stood among CASA de Maryland grievance-mongers who shouted, "No license, no justice! No justice, no peace!" while playing the race card against naturalized Americans and legal immigrants who opposed the illegal alien welfare state.

Perez himself derided secure-borders citizen activists as "xenophobes," but denied painting the grassroots immigration enforcement movement as racist. Questioned by GOP Sen. Jeff Sessions during his Obama DOJ confirmation hearing last year about the illegal alien rights guide produced by CASA de Maryland, Perez grudgingly stated that "the Civil Rights Division must not act in contravention to valid enforcement actions of our federal immigration laws." But "act(ing) in contravention" is exactly what the Civil Rights Division is doing in spearheading the challenge to Arizona's valid enforcement actions of our federal immigration law.

Perez, Attorney General Eric Holder and the rest of the open-borders DOJ team have invoked a "preemption" doctrine based on the U.S. Constitution's supremacy clause to attack Arizona's anti-illegal immigration measure and oppose local and state enforcement of federal immigration laws. Never mind that the Arizona law was drafted scrupulously to comply with all federal statutes and the Constitution.

You gotta love Obama's fair-weather friends of the Constitution. When a state acts to do the job the feds won't do, Obama's legal eagles run to the Founding Fathers for protection. When, on the other hand, left-wing cities across the country pass illegal alien sanctuary policies that flagrantly defy national immigration laws and hamper cross-jurisdiction enforcement, the newfound federal preemption advocates are nowhere in sight.

I think Comrade Zero should head down to Arizona for a conference with Governor Jan Brewer and maybe on the way to the Governor’s Mansion, Sheriff Joe could pull the Kenyan sonuvabitch over and check to see if he’s in this country legally.

Of course that would mean producing a REAL birth certificate instead of the fraudulent digital crap that got posted online by Hussein’s sycophants and enablers.

It is time for 18 to 20 States to join Arizona and create a REAL CONSITUTIONAL CRISIS for the kneyan... one that will drain his efforts to do anything else... that will paint him for the traitorous pos that he is and show the World that this Nation would rather divide itself from the evil of obama than to become the soviet union and north korea combined.

If, as I’ve read, the AZ legislation is, in effect, enabling legislation to enforce existing federal legislation -

Then, this lawsuit becomes about ‘states are not permitted to enforce federal legislation’...

Which is an interesting precedent to set, when the ‘Obamacare’ lawsuits, among other things (such as EPA regulations/mandates?) come before the courts....

Hmmmmmm....

This is interesting, because if I remember, Oklahoma passed a stringent anti-illegal immigration law several years ago, heavily penalizing employers who hire them. Is this law also under the gun?

Obama sure is prepping this country to be open to a Reagan-like president. Too bad there aren`t any new Reagans on the horizon. [Nope, not even the one you`re thinking of.] I fear after a Republican 2010 the American public will feel they have `balance` and let this boob stay on in 2012. Way too early to be making predictions, but it`s a fear.

This arrogant pos must never be allowed to run for a second term. He must be impeached.

In my opinion, the best-case scenario is for Obama to run for re-election and lose in an epic landslide -- like McGovern, Mondale and Dukakis. The world needs to see, not a disqualification on a technicality, but a loud and clear rejection by the American people. Gallup polls aren't going to be reported in Indonesia. An election will.

I really think that the democrats are biting off more then they can chew with using the Supremacy clause as their argument on this.

The Arizona law is NOT in conflict with federal law but in support of it’s enforcement.

Yet santuary cities that clearly void and conflict with federal law are ok with Obama’s DoJ? I would love to hear them spin that one. This is pure politics and not a case of standing for the federal government.

Imagine this: We have federal law which takes jurisdiction over certain waters in the States in order to protect them from pollution. Imagine that the federal government was not enforcing them and allowing certain cities to give sanctuary to polluters. Imagine then that a state mirrors the federal law and decides to go after the people who are dumping chemicals in the waterway. Would the left-wing cry about the Supremacy clause then? Of course not. They would argue that the States were simply backing up federal law. This lawsuit is purely a political temper-tantrum by the Obama DOJ. Nothing more.

If someone believes that AZ law in this case violates the Supremacy clause then ask them where they would stand if the law was a federal anti-pollution law instead of federal immigration law. I am sure that will shut up any left-wing loser out there.

If he's not eligible, that's not a "technicality," that's fraud and treason.

The next step would be to try him in a court of law and execute him.

Regarding the BC issue, I have always believed that Obama really was born in Hawaii, but the BC contains information that would humiliate him -- perhaps showing that his real father is Frank Marshall Davis, for example. It's possible that a Republican-controlled state could force the issue by passing a new law, requiring that candidates wishing to be placed on the presidential primary ballot in that state must give the elections commission a certified copy of a long form birth certificate by a certain date.

Obama would respond by either producing the BC (which he has already indicated by his actions to be unacceptable) or just forfeit a Republican-controlled state that he knows he will lose anyway. I predict the latter. But that would then show, to anyone paying attention, that there's something really fishy about the BC situation. And that would cause a severe drop in the polls, and the epic landslide I'm hoping to see.

I don't just want him beaten. I want him to be beaten by the biggest landslide in history.

I'd like to see General Dave Petraeus as the Reagan of this generation. But no, I don't believe the American voter will accept "balance" through the traditional gridlock of Congress controlled by one party, and the White House by the other. Barring some unforeseen disaster, I think Obama will lose in 2012. The only thing in doubt is the margin of victory.

Size matters. I want a really, really big one.
