Judge orders rewording of initiative to suspend California climate change law

A Sacramento judge on Tuesday ordered Attorney General Jerry Brown to reword a ballot initiative that would roll back the state's landmark climate change law.

In a ruling Tuesday, Sacramento Superior Court Judge Timothy Frawley agreed with measure proponents charging that Brown's office used misleading language when it drafted the initiative, Proposition 23.

As the Democratic candidate for governor, Brown opposes Proposition 23 and supports the state's climate change law, AB 32.

Frawley said use of the term "major polluters" in election materials carried negative connotations with voters and ordered Brown's office to use the less loaded term "major sources of emissions."

"My concern is that the word 'polluters' suggests something that comes out of a smokestack. That's where the prejudice lies," Frawley said.

Frawley also concluded that Brown inaccurately said the proposition "requires the state to abandon implementation of" California's climate change law, or AB 32, and ordered it to substitute the term "suspends."

Proposition 23 seeks to roll back California's global greenhouse gas reduction law until statewide unemployment drops to 5.5 percent for a year.

Supporters of the measure say AB 32, which aims to reduce carbon emissions to 1990 levels by 2020, will lead to job losses and higher energy costs.

I think that headline is not quite right. What the judge is doing is stopping Brown from loading the language that appears on the ballot — not changing the language of the imitative itself.

Yes they do. And in this case, the judge did not order rewording of the “initiative”. He ordered rewording of the ballot language describing the initiative.

The Howard Jarvis Taxpayers Association on Tuesday filed a lawsuit seeking to rewrite the ballot description of Proposition 23, a measure voters will consider in November that would suspend California’s global warming law.

Saying that state Attorney General Jerry Brown had deliberately written a misleading title and summary aimed at killing the measure, the taxpayers association asked a Sacramento County Superior Court to nullify and change it.

“Whether intentional or not, it certainly looks as though the attorney general has crafted a description intended to sway voters to vote ‘no’ on Prop. 23,” said Jon Coupal, president of the Howard Jarvis Taxpayers Association.

Opponents of the ballot measure called the lawsuit a desperate strategy.

“This is a Hail Mary pass from a campaign that is circling the drain,” said Steve Maviglio, a spokesman for the No on Proposition 23 campaign.

A Field Poll released July 9 found just 36 percent of likely California voters in favor of suspending the global warming law, with 48 opposed and 16 percent undecided.

If approved by a majority of voters, Proposition 23 would suspend AB 32, California’s landmark global warming law, until the state unemployment rate drops to 5.5 percent or lower for four consecutive quarters. In the past 20 years, that has only occurred three times, most recently between October 2005 and June 2007.

Moonbeam has a history of sabotaging ballot initiatives that he doesn’t like. He did the same thing with Prop 8, for instance.

Thus ensuring that unemployment will never get that low again in California, since what business would want to move to California, only to have a microscope shoved up its ass after a year of good times?

Also, wanna bet that Jerry Brown does NOT change the proposition's wording? Being a liberal means never having to obey the rules.
