Breyer was appointed to the Supreme Court in 1994 by President Bill Clinton.

Very well said. Bad behavior is being rewarded when the law is adjusted to accommodate it. This just reinforces the use of increasing levels of bad behavior by the extremists to obtain their goals.

Suppressing free speech because of the threat of a violent reaction by the hearers is called a “heckler’s veto” and has already been found unconstitutional.

It’s not like “screaming fire in a crowded theater,” because this is simply an irresponsible or malicious act involving a lie that does not express an opinion of any kind. Speech of this nature and certain others, such as libel, is not protected (except in some circumstances, for example, when it is directed at a public figure). On the other hand, speech expressing an opinion is protected even if it may generate a hostile reaction.

Well, the upside is that he's comparing the danger that is "Islam", to a raging inferno inside a confined space. He's right about that, although I'm sure that's not what he meant.

No joke!! I always thought Breyer was evil. But actually stupid?

After hearing his arguments in McDonald and now this I am convinced he is an intellectual lightweight of the highest order.

I can only imagine the wrath that would come down on him from Scalia during arguments before the Supreme Court on this. Not that the court will have occasion to decide this issue any time soon.
