Yes-it is indeed confusing enough. I think the only reason they arrested the guy was that officers detected alcohol on his breath. He was tested 5 hours after the crash but results aren’t available as of the time the article was written.

As the Honda passes, an on-coming car sees the Honda, instead of swerving to the right, the on-coming car driven by intoxicated Carlos Rodriguez Bobadilla swerves left, crossing the line, into oncoming traffic, killing these motorcyclist.
