March 7, 2011 (San Diegos East County) -- Congressman Duncan Hunter (R-El Cajon) recently introduced legislation aimed at curtailing what he views as frivolous lawsuits against small businesses that are allegedly in violation of the Americans with Disabilities Act (ADA). The bill, entitled the ADA Notification Act, would provide businesses accused of an ADA violation with a 90-day grace period to make necessary modifications.
Its bad enough that small businesses are facing enormous challenges due to the current economic downturn, Rep. Hunter said in a press release. What they dont need to contend with are any other unnecessary obstacles that impede growth and competitiveness. But thats exactly whats happening in San Diego with predatory ADA lawsuits.
Implemented in 1990, the ADA guarantees equal access to all public and private buildings. In addition, the Act prohibits discrimination based on disability. In California, individuals who accuse businesses of failing to comply with the Act may seek monetary damages in excess of those granted under the federal law.

PRO this one. My friend bought a strip mall, SMALL ONE. He had no handicapped parking when he bought it. Seems there is a wheel chair person who drives all over FL looking for these types of violations. His son, the lawyer then handles the suit, stretches the time out, adds additional alleged violations, etc. After seeing the time charges mount, my friend made any and all possible changes to preclude the greedy lawyer b’tard from running up the expenses with delays, approval contentions etc. Cost my friend $30K but stopped the lawyer from his efforts to take the place by fiat.
A bill like this is long overdue. ADA lawsuit abuse has become almost legendary for menacing towns and small business here in SoCA.
I find it disturbing that I got that.
Hunter has the right idea, quit allowing liberals to abuse the court system to enforce their vision of the laws like ADA and ESA.
