The U.S. Supreme Court reinstated a Sacramento man's conviction and life sentence Monday for the rape of a 72-year-old woman in her apartment, dismissing an appellate court's decision that the prosecutor may have had racial reasons for removing two African Americans from the jury.
The Ninth U.S. Circuit Court of Appeals in San Francisco had granted a new trial to Steven Frank Jackson in July. The court said the prosecutor at Jackson's 2004 trial had used pretexts to justify his challenges to the two African American jurors, because the reasons he gave could have applied to jurors he left on the panel.
The Supreme Court, in a unanimous ruling, called the appeals court decision "inexplicable." The appellate judges should have deferred to state court rulings that upheld the prosecutor's explanations, the high court said.

The Ninth Circuit is such an obvious joke that the Court doesn’t even need to hear oral argument. It simply summarily reverses the Ninth Circuit.
Unanimous ruling? Wow, it must have been an idiotic decision by the 9th Circuit if you got Obama’s appointee to agree that it was pathetic.
The members of the 9th Circus should be made to do the same amount of time as the perp, because the 9th Circus is constantly being overruled by the higher court.
That decision is as inexplicable as it is unexplained. It is reversed... The state appellate court’s decision was plainly not unreasonable. There was simply no basis for the Ninth Circuit to reach the opposite conclusion, particularly in such a dismissive manner.

Its amazing that they don’t even know their the laughing stock of any court in the world.

These idiots are a major blemish on the US legal system.
No matter how divided the Supreme Court gets, the Justices always have the Ninth Circuit to bring them together.
The Ninth Circuit Clowns are the face of what the democrat party wants for the court system at large! We reject the idiocy but continue to allow the pushers of same to hold national offices. Go figure
So where are the rest of us non-minority TAXPAYING CITIZENS supposed to go for justice when an appellate court is so obviously racist and liberal, and the Supremes doesn't even comment on it, thus allowing it to stand?
There is no justice unless you're a member of a politically protected class having the right skin color or genitalia.
Thus for a color-blind/sex-blind society.
The 9th. Circus Court of Appeals is such a joke, even liberals on the U.S. Supreme Court find it exasperating and override them routinely.
