A Texas judge declares spanking a child a crime
SFGate: The Mommy Files ^ | 6/23/11 | Amy Graff

A Texas woman was sentenced to five years probation after pleading guilty to the charge of Injury of a Child. What did this Corpus Christi mother of three do? She spanked her then nearly 2-year-old daughter.

"You don't spank children today," said Judge Jose Longoria. "In the old days, maybe we got spanked, but there was a different quarrel. You don't spank children."

A Texas judge declares spanking a child a crime

Looks like the judge has forgotten which branch of government he's in.

So do we throw them in jail for a month or two?

This judge needs a spanking, and then sent to “time out” in the unemployment line.

I’m shocked this is a Texas judge.

Oh the HORROR!, They should have executed her/SARC

This just needs to serve her probation then deport him to Mexico. The guy is a few nuts short of a fruit bar.

Sounds like he thinks he is all three.

Sounds like this judge is imposing his morality on others.
Leftists never were against doing this, no matter how much they decry it publically.

They want to impose THEIR morality, and suppress yours.

So why in the blazes did she plead guilty?!? Any decent lawyer would have got the case thrown out before it ever went to trial and certainly would not have advised his client to plead guilty to such a baseless charge. This story isn’t as much about spanking as it is about extremely poor legal council.

Texas has been getting some real clunkers for judges lately. The current judge in Gillespie County (Fredericksburg) has been handing down some sentences that indicate some serious lack of spine. The prosecutor in that county is a real winner as well.

This is a little misleading. The article says the grandmother took the child to the ER because of marks on her behind. A two year old doesn’t need to be hit so hard/often that it leaves marks.

When it comes to free legal advice.. You get what you pay for. I do think the lawyer appointed did her a disservice.

A little more detail from the story.

Her daughter's paternal grandmother noticed red marks on the child's bottom and took her to a hospital to be checked out,

"Texas law allows the use of force, but not deadly force, against a child by the child's parent, guardian, or other person who is acting in loco parentis."

According to the story I think Texas should stop use of force before deadly force.

The Judge seems to be comparing apples and oranges.

Yes, one does spank in this day and age—even 2 year olds. A pat on the bottom or the back of the hand for those activities which will put them in danger. (There comes a point when saying NO! or putting them in time out does not do the trick when they are determined to remove the safety cover from the electrical outlet, LOL!)

Leaving marks on the bottom of a 2 year old is not a spanking. It is a beating.

I have learned through experience to use my spankings wisely. I only had to spank my youngest (now 20) child once when he was 3. I forget what he did, but it warranted a turn over on my knee. From then on out all I ever had to say was “Do I need to get your attention?”

I’m not sure if the Tea Party monitors appointments of judges. If they don’t, this needs to be added. I just sent an inquiry to my Tea Party.

I find random spakings the most effective. This way they have to keep guessing what they did wrong.

person who is acting in loco parentis? That’s what the article says.

The woman should have said “Judge, when punks come before you for breaking the law and gang activities, ask them if they ever got spanked. I’ll bet you they didn’t. Their daddies were nowhere to be found and their mothers were weak. And then let the mothers tell you how good their little boys are.”

Maybe we should just give spanking a name change.
