Best I can tell, they seem to be reasoning that since legislation like that normally includes a severability clause, they'll just proceed as if there were a severability clause in there.

I was thinking the same thing. Why don't they include or remove other parts of the nightmare Obamacare bill.....That's their job right? To proof read and make impovements on the Bills passed by Congress....../barf off.
