Biological dad's name off girl's birth certificate after lesbian couple splits

A MAN who donated sperm to a lesbian couple will have his name stripped from their child's birth certificate after a successful legal bid by the birth mother's ex-partner.

The woman took the NSW Registry of Births, Deaths and Marriages, and biological father, to court in May to have his name replaced with her name in the document.

The female child was born in 2001 and the women split in 2006, although they continued to share parental responsibility.

The man also played a role in the child's life.

New South Wales District Court Judge Stephen Walmsley today ruled in her favour, but expressed sympathy for the biological father.

"I am not persuaded there is any contractual right which can affect this application," he said.

"As (the biological father) concedes, there was no agreement before (the child's) birth that he would be on the register when he agreed to donate his sperm."

She can strip the name legally I guess, but she will never be the father of the baby, no matter what she does.

That power is not in the hands of any human agency, and is certainly not hers to seize.

Men should never donate sperm to be used to fertilise Lesbians.

It is an abrogation of the male responsibility and duty.

This is gonna complicate those 'Yours. Mine, and Ours' families. Have to add 'His, Hers, Theirs, Somebody’s, Whoever's, etc.'

A kid could get real confused.

Birth certificates are meaningless if they are not immutable records of fact.

Amend, don't revise.

I don't care if you're adopted, I don't care if you've cutting off your genitals. The birth certificate should be what really happened.

As one guy I know put it: I’d never donate sperm because you never know what they’re going to do with it, and 20 years down the road you could have a son & daughter you’ve never met become husband & wife.

Indeed. With the way our culture is going, they’ll probably be an “incest rights” movement requiring brother-sister marriage soon, I’m very sad to say.
