Using a 1935 law.. some think you may owe the state more money.
If youve had something shipped to your home from out of state .. you may owe the state of California more money.
The tax board is talking about collecting the so-called use tax for anything that youve had delivered to your home from out of state. (Theyre looking for new ways to collect taxes.)
Never heard of the Use Tax? Youre not alone.
They dug deep to get this one - under a 1935 law, Californians would owe a use tax on any out-of-state purchases. Thats right a 1935 law.
But to collect the money, the state is considering looking at shipping records to find out what youve had shipped to your home. So in theory - your UPS and FedEx records could be used against you to collect more taxes money for the state. But for now - its just talk.
Does that include the U.s. Mail?
You don't pay the "use tax" on retailers or parts assembling, they just pass the taxable liability. The retailer doesn't pay the use tax because he's going to sell it to the end user. The factory making bolts doesn't charge the final assembly plant tax because he's passing that taxable item on to the end user.
Any business staying in the People’s Communist Republic of California is suicidal. My wish is for the MILLIONS of conservatives who live there to flee to the low-populated Demon-rat states (see: Vermont, Rhode Island, Maine, and make them RED.)
A better alternative, of course, would be for the people of California to wake up and realize Hussein, Jerry Brown, and RINOs like Arnold are not their friend. (Mea culpa: I thought Arnold was a good guy going against Gray Davis, but the Terminator fizzled out and become a wuss.)
Californians who do so might be in for a culture shock. The winters in those states are long and cold, and there are no burritos. On the other hand, it's hard to find a good Italian sandwich in California.

Sure, I'll give up near perfect year round weather, and move to Maine. The east coast humidity and bone chilling deep freeze weather is so attractive.
We even had an earthquake for them to make them feel at home.

why not just repeal the 1930’s law?
given california’s referendum process this should be easy.
