Why didn’t the police lodge a general charge of homicide (PA Crimes Code 2501)? The jury can determine the grade.
Second, commission of a felony (armed robbery F1 and Criminal Attempt - Homicide F1) that results in death, even if it is your accomplice at the hands of the intended victim, is defined in PA criminal law as second degree murder (PA Crimes Code 2502 (b)). Period.
Why involuntary manslaughter? That is a pretty low grade of offense considering (M1).
