Not just the EPA.

If the Republicans were serious about smaller government, and didn't want to control it and expand it to support their agenda, they would propose something like this:


Regulations are not Laws Act

No regulation proposed by the Executive Branch or any agency thereof shall have the force of law until it is passed by a majority of both houses of Congress and signed into law by the President.

All regulations currently documented in the "Code of Federal Regulations" will sunset 5 years after the passage of this act, unless those regulations are presented to Congress and passed by a majority in both houses of the Congress and signed into law by the President.
I've emailed and faxed that proposal to my Establishment, Ruling Class RINO Congress Critter, but received no response so far.

They’re up to something

They don't want the pain of higher energy prices to hit until AFTER the election. If he manages to get re-elected, all bets are off. If Perry or another Repub gets in, we can hope that the insanity is stepped on by Executive Order.

All regulations from the EPA with the force of law (ie, ALL) should be required to be approved by Congress.

ANYTHING that dictates ANY form of compliance to the Federal Government while at the same time providing ANY kind of sanction or punishment for failure to do so should be approved by BOTH houses of Congress and signed by a duly elected President of the United States. This is called a LAW, and the US Constitution explicitly directs the LEGISLATIVE process by which it comes into being.

Regulations are LAWS, and should be viewed as such. Any regulation/regulations that do not follow the specific afore mentioned process, are nothing more than EXECUTIVE LEGISLATION, also known as TYRANNY!

I cannot seem to put my finger on the specific clause in the US Constitution that allows Congress to delegate it's legislative authority to the Executive branch of government...

Overruled the EPA huh. That’s funny, as they’re the jackboots who have been responsible for implementing much of his crushing agenda.


It’s even funnier because the EPA works solely under the direction of the President. Welcome to the twilight zone where the President’s right finger overrules his left toe.

The legislative (law making) powers are Constitutionally vested only in Congress, and as you both said, have to be passed by both houses of Congress and signed by the president.

To punish anyone under a federal “regulation” that has not gone through this process needs to be rule unconstitutional by the Supreme Court. We just don’t have the right makeup on the court to do this. It would be very “ballsy”, and would certainly put the Leviathan back in its cage.

But, it would cost a lot of people a LOT of power, and most couldn’t stomach such a situation.

Obama is toast and will announce not running for a second term. Huntsman will switch parties and run as the democrat. There, problem solved.

GOP best have an outstanding candidate.

If Obama were smart, which he is not

He would direct an executive order to dramatically decrease the regulatory burden on the business environment, change the legal regulation to Loser-Pays-All, permit the drilling for oil in already known sites, and ditch the Labor Union supports of the Federal Government, fire the Ideologues in his administration, and take a race/gender/religion blind approach to governance

But he is not smart, and cannot change his ideologue spots...
