Federal law may say that but multiple courts, including the 10th Circuit, have ruled no student has standing to sue because that right wasn't included in the law.

Earlier this year, SCOTUS declined to review a case over CA in-state tuition based on that same statute.

It seems the feds would have to sue the states.

Thanks, but I already knew that. I posted the law because I wanted to point out that federal law prohibits giving instate tuition to ILLEGAL aliens, be it in Texas or here in California. I am aware that the feds would have to sue the states just as the Obama admin. did Arizona regarding S.B. 1070.

I can understand the liberals in the liberal state of California violating federal law in order to pander to the Latino population but what I don't understand is why people calling themselves 'conservatives' would do so in the state of Texas.
