COMMENTARY | Sarah Palin is threatening to sue Crown Publishing Group (CPG), publishers of Joe McGinniss's book titled "The Rogue: Searching for the Real Sarah Palin." Palin is threatening to sue due to what her lawyer calls "series of lies and rumors presented as fact" and for "knowingly publishing false statements."

I can see November 2012 from Sarah Palin's front porch.
I wonder who Palin has ever criticize about their personal life? Certainly she has criticized opponents policies and public corruption. I can no think of an example of her criticizing anyones private behavior.
No matter what Sarah Palin does in this situation, she will be bashed:
1. If she DOES NOT SUE McGinnis, the party line will be, “Well, if it’s false, where’s her libel lawsuit? Her inaction is a tacit admission that the book is all true!”
2. Since she HAS SUED, the party line (as we see) is, “She’s just as bad as McGinnis. She should have a THICKER SKIN.”
My only concern, if I were advising her, would be adding to McGinnis’s sales due to the extra publicity a lawsuit will provide. But I surely can’t blame her for proceeding — especially in light of that email in which McG essentially admitted that he had no documentary proof of many of the rumors in the book.
Boycott everything CPG.
Now Palin knows how Jeffrey McDonald feels.

The only people who are going to buy that book are reporters and hard-core leftists. I don’t see a downside.
I do see a big upside. Left unchallenged, if she enters the race, the accusations in this book would have been all the news media wanted to talk about. By putting out McGinniss’ very damning email and then getting her attorney involved in sending a letter to Random House, she is putting all news outlets on notice that they will be added to the lawsuit if they discuss these false allegations on air. I find it significant that once those two documents were released, Olbermann, Maddow, and NPR all cancelled interviews with McGinniss. None of them want to be sued. Effectively, this takes these false allegations off the table during any Presidential campaign she might decide to run.
...this goes back to Palin's devastating take-down of Obama in her speech to the Republican convention in 2008. The MSN took it too personally and have childishly sought revenge against Sarah ever since.
But I thought as a “public figure” she has almost no chance of winning a libel suit, according to the Sullivan case.
Notice how many lefty Palin hate venues spewing their lies have suddely gone dark and silent? Hmmn, I wonder why?
Who really cares how Jeffrey McDonald feels? Maybe after dealing with McGinness he knows how his wife and three kids felt.

You are right that Sullivan sets a very high bar. “Actual malice” against a public figure means that, at the time of publication, the publisher either (1) knew the material published was false, or (2) had “reckless disregard” as to whether it was false. (The latter basically means an attitude of, “Hey, maybe it’s true, maybe it isn’t. I know that. Let’s publish anyway.”)
What makes this particular case stronger is the existence of an email from McGinnis in which he openly complains that, after all his digging, he has essentially no evidence to support all these dirty rumors.
Governor Palin won this battle.
It’s already over.
McGinnniss can’t publicly say anything, it can be used in court against him.
The MSM can’t have him on the air, anything they say can be used in court.

I thought about that. The “malice” and “recklessness” are pretty easy to prove. I wonder how Kitty Kelley keeps making her best-selling biographies on that basis. On the practical side, Palin is in a box,as you said. Let the book flop (As it seems the case) or go after the author. If she does, she looks petty and thin-skinned, and makes McGiness a millionaire for “promoting” his book. If she doesn’t, she eats yet another $hit sandwich, and tacitly “agrees” with the book’s premise.
