The U.S. Senate confirmed the appointment late Thursday of Judge Xavier Rodriguez to federal judgeship in Texas.

Frank Montalvo was also appointed to a new seat in the Western District, currently set for El Paso.

Both were nominated for judgeships for the Western District of Texas. Senators Kay Bailey Hutchison and John Cornyn recommended the two to President Bush. Rodriguez was nominated to fill the vacancy left when Judge Edward Prado was named to the 5th U.S. Circuit Court of Appeals. Cornyn’s office said Rodriguez was approved on a voice vote.

“Frank Montalvo and Xavier Rodriguez will only add to the exceptional tradition of judicial excellence the Western District has long enjoyed,” Cornyn said Thursday night in a statement from Washington.

“Judge Rodriguez brings the qualifications and integrity to the bench that Texas and our nation need now,” Hutchison said.

Rodriguez, a San Antonio native, was appointed to the Texas Supreme Court by Gov. Rick Perry in 2000.

A partner with the firm since 1987, Rodriguez rejoined Fulbright & Jaworski’s San Antonio office in November 2002 after serving as a Justice on the Supreme Court of Texas, focusing on the areas of labor and employment law and general litigation.

Rodriguez has represented both corporations and individuals who have been sued by their present or past employees based on alleged discrimination, harassment, retaliation, breach of contract, or breach of a noncompetition agreement. In addition, Rodriguez has handled a variety of general and commercial litigation matters.
