DA releases report on Nagy shooting

(911 calls at link) BEVERLY Ma.-- Hamilton Police Sgt. Kenneth Nagy shot Beverly Police Officer Jason Lantych because Nagy believed Lantych was having an affair with his wife, according to a summary of the investigation released today by the Essex County District Attorney’s Office.

The report says Nagy texted Lantych early on the morning of the shooting and said, “Hey Jay ... thanks a lot buddy,” then called Lantych an expletive and texted, “See you soon my friend.”

Nagy, described as “distraught” over the alleged affair, fired two shots through the open window of his SUV at Lantych after the two had arranged to meet at Starbucks in North Beverly on Feb. 24. He returned to the scene five hours later and killed himself inside his SUV with a gunshot to the head.

The investigation concluded that there was no “prosecutable crime” surrounding the shooting and suicide.

The investigation summary also revealed that Nagy left a suicide note on a laptop computer at his Rowley home along with $3,900 in cash. The suicide note was created at about 5 p.m., less than an hour before the shooting.

Investigators laid out the details leading up to the shooting starting on Feb. 23, the day before. They said Nagy arrived at his home in Rowley at about 7 a.m. after working the midnight shift. At 10 a.m., he attended a doctor’s appointment and was prescribed Zoloft.

Two hours later, Nagy met his wife, Katherine, at the Beverly Police Department’s satellite domestic violence office, where she works as a victim advocate, to discuss his medical appointment.

At 6 o’clock that night, Nagy and his wife attended the funeral/wake service for retired Hamilton Police Sgt. Paul Grant. Nagy was posted in uniform at the entrance to the funeral home and left the service early.

Nagy went to the Sprint store at 11 Enon St. in Beverly, near the Starbucks, complaining of problems with his cell phone. He later returned home and was scheduled to work the midnight shift again.

But instead of going to work, Nagy left his house at midnight and drove around. About an hour later, he returned home and woke up Katherine.

At the time Nagy told Katherine that he believed she was having an improper relationship with Lantych. The discussion included the possibility of divorce.

Tough to hear the 911 calls in a way due to a voice timestamp left on the recording. A woman (the Bev. dispatcher has a tough time hearing her at first) says shots fired, poss.
robbery at Eastern Bank in N. Beverly; a man calling himself an “off-duty” (officer) “from Nahant” reporting the shooting.

This took place at a mini-plaza in N Beverly with an Eastern Bank, a Starbucks, and a Bertucci’s restaurant

We don’t know yet and not sure if the officer who was shot (in the groin) or Mrs. Nagy will talk publicly about it.
Ofcr. Nagy took his own life 5 hrs after the confrontation
with Lantych.

“Based on the evidence gathered, investigators found that Nagy shot Lantych because of his perception of a relationship between Lantych and his wife,” said Blodgett, who called the shooting “shocking and deeply unsettling.”

The DA had been looking into the relationship between the divorced Lantych and Nagy’s wife, Katherine “Katie” Nagy, 32, a mother of two sons aged 5 and 7, who works as an advocate in the Beverly police domestic violence unit.

But in concluding a weeks-long investigation that included 21 interviews and reviews of phone records, video footage and ballistics, Blodgett said “no prosecutable crime has been committed” outside the shooting, telling Beverly Police Chief Mark Ray and Hamilton Police Chief Russell Stevens in separate letters that his office will no longer probe the incident.

Beverly police spokesman Officer David Costa told the Herald last month the department was unaware of any relationship between Lantych and Katie Nagy that went beyond interacting on cases. The department does not have any formal policy addressing personal relationships “as long as it doesn’t interfere with your work,” Costa said.

Here is the DA’s release:

District Attorney Jonathan W. Blodgett today announced the findings of the investigation into the February 24, 2012 non-fatal shooting of off-duty Beverly Police Officer Jason Lantych by off-duty Hamilton Police Sergeant Kenneth Nagy and Nagy’s subsequent suicide. In a letter to Beverly Police Chief Mark Ray and Hamilton Police Chief Russell Stevens, Blodgett detailed the findings of the investigation and concluded that “no prosecutable crime has been committed.”

The investigation was conducted by Massachusetts State Police assigned to the Essex District Attorney’s Office. The primary goal of the investigation was to determine whether any criminal activity on the part of some person or entity occurred in connection with the shooting and suicide. The careful review of the investigative reports and materials, which included 21 citizen-witness interviews, videotape footage, audio recordings, ballistics evidence, computer forensic analysis, and phone records, found that absent the shooting itself, no other criminal activity occurred.

Based on the evidence gathered, investigators found that Nagy shot Lantych because of his perception of a relationship between Lantych and his wife.

“The events of February 24 were shocking and deeply unsettling. An off-duty police officer using his service weapon twice shot another police officer outside a crowded Starbucks, and later returned to the scene and took his own life,” Blodgett said. “[T]he mandate of the District Attorney in such cases is to determine whether a prosecutable crime has been committed. I have determined there is no such crime, apart from the shooting committed by the deceased Nagy. Therefore, this investigation is concluded.”

It’s a sad story, for sure. What struck me was incompetent the cop was at carrying out the murder of his rival or committing the crime in manner that would offer him a fair chance of escaping detection. You would think that a professional cop could do a better job. Of course, he must have been distraught.

What guy wouldn’t commit suicide because of the “perception” his wife was having an affair? Sure makes sense doesn’t it!

One piece of video showed the two of them inside Starbucks’ talking, then the shooting occurred in the parking lot.

Lantych suggested that the two meet at Starbucks joking that it was so Nagy couldn’t shoot him. [i.e., “in a public place”]

Lantych said Nagy appeared upset but was calm. After the two men left Starbucks Nagy backed up in his SUV and Lantych walked toward to him, Nagy then fired two shots from inside his car towards Lantych, hitting him in the thigh and the wrist.

Nagy fled but returned to the scene where he shot and killed himself.

According to reports from the Beverly Police Department, Lantych — in the hospital one day after the shooting — told investigators that he has known Nagy’s wife since high school and that, “I had a moment of weakness with Katy [but] I was never intimate with her.”

The report also quoted Lantych as saying he and Katy Nagy, “...had a relationship that first started as confiding in each other and got out of hand.”

Police say Katy Nagy stated that her husband had just become aware of her “emotional relationship” with Lantych.

Police found suicide notes shortly after the shooting, one in Nagy’s home and one in his car. In both notes he said he hoped he’d meet Lantych to shoot him and that he was going to kill himself.

Because Lantych recovered from his injuries and Nagy committed suicide the police have closed the case.

The report also mentioned that Nagy had been prescribed Zoloft the same day as the shooting.
