Nadia Lockyer lied about offering legal advice to ex-lover, attorney says

Alameda County Supervisor Nadia Lockyer is lying when she says she visited ex-lover Stephen Chikhani in jail last summer in her professional capacity as an lawyer, Chikhani's attorney said Wednesday.

"I know she signed in as a lawyer, but they were not legal visits," said attorney Adrienne Dell, of San Jose. "She definitely abused that; there's no question in my mind. They were still in a relationship."

The Bay Area News Group's public-records request uncovered jail logs denoting two of Lockyer's visits to Chikhani in Santa Clara County's Elmwood jail in Milpitas, on June 15 and June 22, 2011. Dell said Wednesday that another visit occurred about a week later, and a fourth occurred in August. In addition, Dell said, it was Lockyer who picked up Chikhani when he was released later in August.

It was unclear late Wednesday why the other two visits were not recorded in the jail logs, if what Dell says is true. The sheriff's office, which initially had refused to provide the logs, did not return phone calls and emails this week seeking clarification of the logs and the jail's policies.

Lockyer, who returned to work Tuesday a month after announcing she was entering rehabilitation for an undisclosed addiction, said Tuesday she had made the two June visits at Chikhani's father's request to render pro bono legal advice and was "not involved" with Chikhani at the time. Lockyer, who has a law degree but rarely practices law now, acknowledged she "was not the attorney of record."

"She's making really serious allegations against my client and she's not a truth-teller, so it's nice to be able to document she's not telling the truth," said Dell, who at the time of Lockyer's jail visits was not representing Chikhani.

"You'd think that after the rehab if she was going to come clean she'd come clean, but she's still carrying around some allegations that are pretty untruthful," Dell added.

Through her interim chief of staff, Lockyer on Wednesday declined to comment on Dell's accusations.

Lockyer, 40, of Hayward, has told Newark police that Chikhani -- whom she reportedly met when both were in rehab in 2010 -- beat her up Feb. 3 in a hotel room. Because she's a former Alameda County District Attorney's Office employee, county prosecutors handed the case off to the state Justice Department, which is still investigating and has not yet filed any charges.

Dell said Chikhani, 35, of San Jose, was jailed from June through August for having violated probation on a methamphetamine conviction but had no new charges pending against him, so he would have had no need of the legal advice Lockyer now says she offered. Dell also refuted Lockyer's claim that Chikhani's father asked her to visit and advise his son.

"He never has ever talked to her about any legal issues regarding his son," Dell said.

Santa Clara County guidelines say inmates may have only two 30-minute visits per week from regular visitors. As an attorney, however, Lockyer was allowed longer visits: The first was 55 minutes, and the second lasted two hours and 35 minutes. To preserve attorney-client confidentiality, attorney visits also are afforded more privacy than regular visits.

Dell said it's the Santa Clara County Sheriff's Office's policy that only an inmate's attorney of record is allowed to visit a prisoner at Elmwood.

Lockyer is the wife of state Treasurer Bill Lockyer, 70, of Hayward, whom she married in 2003. They have an8-year-old son.

Her 2010 supervisorial campaign was buoyed by more than $1.5 million in transfers from her husband's campaign committee.

Stephen Chikhani appears in Superior Court on drug possession charges at the Terraine Courtnhouse in San Jose, Calif. on Feb. 28, 2012. Lawyer at left is unidentified. Chikhani is the ex-lover of Nadia Lockyer of the Alameda County Board of Supervisors, District 2. He is accused of allegedly attacking Lockyer earlier this month in a motel room, but has not been charged with any crime. Nadia Lockyer is the wife of Bill Lockyer, State Treasurer.
