KNOXVILLE, Tenn. (AP) - A man convicted of child rape in Knox County has been granted a new trial after arguing that a pill-addicted judge presided over the original trial.
Jayson Bailey was convicted in April 2010 on four counts of child rape. Former Judge Richard Baumgartner sentenced him to 38 years in prison.

Hard to argue, really. A stoned judge has no business on the bench.
This whole story makes me sick and I spent many hours in his courtroom.
I am really heartsick for the Christian and Newsom families. Given the damage, heartbreak, and expense he caused, the punishment should have been much more harsh.
Every case he has tried, since started being a judge is going be eligible for review, as every one of these cases are compromised by his drug use.
I do like the idea of random drug testing for all government employees, especially judges.
When I read this headline I thought it was going to be about a particular general sessions / circuit court judge in Sumner county that is notorious for his love of cocaine, and street walking women. No chance of that, this is about the Honorable judge Baumgartner.
