Administration doubles down on plea to contractors amid pending layoffs [Sen. Thune responds]

The Obama administration has doubled down on its plea to defense contractors not to warn employees about possible layoffs due to looming budget cuts -- going so far as to offer to cover legal fees in compensation challenges.

The move drew a stern rebuke Friday from South Dakota Republican Sen. John Thune.

"For the second time, the Obama administration has now encouraged government contractors to ignore the WARN Act and hold off on warning employees about possible layoffs due to the looming sequestration cuts,” Thune, lead author of the Sequestration Transparency Act, said Friday.

The offer to pay the legal fees was included in a memorandum issued by the administration Friday that also restated the Labor Department's position from July that contractors should not issue written notices to employees because of the "uncertainty" over the across-the-board cuts to the defense budget and other federal spending that will occur Jan. 2 unless Congress reaches a new deal.

The notices are required under the Worker Adjustment and Retraining Notification Act and generally require employers with more than 100 employees to provide 60-day notices of "mass layoffs if they are reasonably foreseeable."

The projected $500 billion in Pentagon cuts under the so-called sequestration will occur because Congress failed to agree on a deficit-reduction plan this summer.

It amazes me how the administration thinks the masses are utterly stupid and uninformed. Don’t they realize defense industry workers are following this issue in the news media, talking about it at work and contemplating worst case scenarios?

Zer0 ain’t gonna do nothin’ unless he signs an Executive Order mandating that the WARN Act is not applicable to defense contractors, ‘cause he can’t authorize illegal payments to nobody.

I agree. Laws are for the little people. The upper echelons in government get away with anything they want. Hillary and Holder should have been fired or impeached by now. Susan Rice the same, but the crooks just stay and stay and stay. Michelle Bachman tried to expose Huma, who, by the way, seems to have gone underground. Nothing ever happens.

already started... BIG FLATS, N.Y. (AP) — Sikorsky Aircraft Corp., citing declining military budgets and a tough economy, said it will close its plant in upstate New York and eliminate all 570 jobs. Employees at the 5-year-old facility, which has seen its ranks dwindle from a peak of 1,300, were told Monday that the plant would close as of Dec. 31 and its work transitioned to Sikorsky's West Palm Beach, Fla., facility.

My neice’s husband is one of the lucky 14 or so who get to stay until December 31st to make sure the lights get turned off. I understand the rest are out of there by October 31st.

If Obama wins, then he will punish all contractors who defied him, regardless of the law.

If Obama loses, then he has no power to punish anyone. Any contract cancellation executive orders he issues during his lame-duck period can be rescinded by Romney.

It will all come down to who the defense contractors think will win.

i believe that's true... and the expansion at the airport isn't even finished yet! sounds like they got blindsided, no way would they put all that time and money into it if they dint think they needed it
