The Al-Madany Islamic Center of Norwalk in Connecticut wasn’t ready to give up when its proposal for a 27,000 square foot facility was turned down by the zoning commission over matters completely unrelated to religion. The Islamic Center sued, asserting—as you might have guessed—it was religious discrimination. The cry of “Islamophobia” got the Justice Department on its side, and the zoning commission suddenly changed its mind after a closed session.
The current Islamic Center was established in 1999 and serves 100 families. Feeling that more space was needed, the Center purchased the property in 2008 and made the $3.5 million proposal in the spring of 2010. It calls for a facility with an 80 foot minaret to serve as a community center and mosque, including eight classrooms, two libraries, three offices, a kitchen, a gymnasium and other rooms. It has a capacity for 1,000 people.
The proposal was rejected in June. The officials and residents that opposed it never referenced Islam and repeatedly emphasized that religion had nothing to do with it.
Mayor Richard Moccia said, “It was not based on any religious bias.” Commissioner Adam Blank said community centers are not allowed in triple AAA residential zones. Additionally, he said, parking was only allocated for the prayer hall that is 3,000 square feet, leaving the rest without parking.

In MA the town wouldn’t stand a chance thanks to our horrendous Dover Amendment.
“The Dover Amendment is the common name for Massachusetts General Law (MGL) Chapter 40A, Section 3. This law exempts agricultural, religious, and educational corporations from certain zoning restrictions. It allows a structure that provides certain services to ignore local zoning laws and build the facility it needs to provide those services. The Dover Amendment allows many developers to build facilities that are substantially larger than zoning laws would ordinarily allow or which would be considered inappropriate, by some, for the neighborhood.
Considered by many to be overly broad, the exemption granted by the Dover Amendment has been narrowed somewhat by recent court decisions. While a corporation must merely be nonprofit and legally able to engage in educational activities to be considered a “nonprofit educational corporation,” the actual use of a particular facility must have education as the “primary or dominant purpose” to qualify for Dover protection. See Whitinsville Retirement Society, Inc. v. Northbridge, 394 Mass. 757, 760 (1985).

The nation was created to be a constitutional, representative republic. We have devolved into a nation that is now governed by fiat. Executive orders now create laws - it's illegal! Similarly, federal and state courts now "create" laws - it's illegal! And again, we have our federal government running rough shod over the states - dismissing entirely the 10th amendment, i.e., ""The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people" - it's illegal!
The problem is that we have a Congress that is beholding to political party above the people it was elected to represent. Our Congress has illegally given power to create law to the President and the Court(s). They have done this for political advantage (read for party or self advantage). Until we have a Congress that places the will of the people over party or self, we will continue to devolve as a republic.
