I doubt that this restriction applies to any but public employees.It applies to all licensed mental health professionals. Any such counseling could result in a loss of the professional license.

Frankly, this is on the edge of a free speech restriction, but then, I'm opposed to State licensing of professionals in principle. Third-party certification and insurance can fill that role just fine.
