As per NJ law, they stink by the way, the defendant did a number of things wrong. In NJ you can only transport firearms unloaded in a locked case separate from the ammo. The loaded handgun is forbidden. It should be in the trunk or a vehicle with no trunk as far away from anyone in the vehicle as possible. In NJ you can only transport a firearm from the store to home or business(that you own) upon purchase. Then you can only transport between home, business, hunting, or range. Nowhere else is legal. When doing so, you can not stop for any other reason, a cup of coffee, a friends house etc. Stopping for a nap is a violation. If he contiued another 15 minutes over the Delaware he would be alright. You can travel thru NJ with a properly stored firearm per Federal Law as long as you do not stop. NJ has a 15 round magazine limit with no grandfather clause. Thus any magazine he had over 15 would be illegal in NJ. As for the search, any thing visible to someone outside the car that indicates a firearm may be present is probable cause, be a package of splatter targets or a soft rifle case. His biggest mistake was not doing just a little research, which is readily available from the NRA site, of the firearms laws of the states his was passing thru. If he just made sure nothing was in plain site, and kept is mouth shut when questioned by the police, he be home free in Texas right now.

Good grief ... there should be some kind of allowance for out of staters who get caught in these draconian gun laws.
